Guidance for Residency (TIE) in Spain

Over the past few months, we have seen a huge number of enquiries for people wanting Spanish Residency in  Alicante – Spain (Residencia now TIE). Here you have all the information about Residency in Spain (now a TIE).

This article is to advise you that it is important that all clients who do not have Residencia (now TIE) and padron and need them should obtain them before 31st of  January 2020 . After this date we don’t know how difficult it may be to obtain TIEs afterwards.


Why is this? What is the situation with Residency in Spain after Brexit?

If you refer to the GOV. UK website in the UK there is a great deal of information there to read.


What is the agreement on rights for UK nationals in Spain?

At the beginning of January 2019, there was an update by the Foreign Office, on the rights and status of UK nationals living in the EU following the triggering of Article 50.

  • UK nationals, as well as their family members covered by the agreement. They are lawfully residing in Spain by 31st January 2020, will be able to continue to reside in Spain.
  • Children born or adopted outside of a UK national’s resident  State after the 31st January 2020 will also be covered by this agreement.
  • Close family members. (spouses, civil partners and unmarried partners, dependent children and grandchildren and dependent parents and grandparents), will be able to join UK nationals in Spain after Brexit under these rules. This applies where the relationship existed on 31st January 2020 and continues to exist when they wish to move to join their UK national family member.
  • UK nationals and their family members covered by the agreement will be able to be absent from their member state of residence for up to 5 years, without losing their right to return. Also, they will continue to have the same access as they currently do to healthcare, pensions and other benefits.
  • Where an application is required to obtain Spanish status, UK nationals will have at least two years to submit their applications.


UK nationals who move to Spain after 31st January 2020

For UK nationals who move to Spain after the UK’s withdrawal on 31st January 2020, they can still live, work and study in Spain after the UK has left the EU. How long this period lasts is subject to negotiations, however, it is likely to be around 2 years.  Details of the immigration rules for UK nationals who wish to move to the EU after 31st January 2020 are yet to be agreed.


UK nationals in Ireland

( By the way) The rights enjoyed by UK and Irish nationals in the Common Travel Area will not be affected by the UK’s exit from the EU.


Current status of UK nationals in the European Union and specifically Spain.

Until the UK leaves the EU, the UK remains a full member of the EU and all the rights and obligations of EU membership remain in force.

This means:

  • UK nationals can continue to travel freely within the EU using a UK passport
  • There continues to be no visa requirements for UK nationals entering another EU country
  • UK nationals can continue to access health care during temporary visits to EU countries using the European Health Insurance Card
  • They retain their legal status as EU citizens and can continue to work and live in EU countries
  • British people can continue to retire and collect their pensions in EU countries

Post-Brexit and 31st January 2020

The withdrawal agreement is still being discussed. British citizens will no longer be entitled to reside in Spain under the existing status now.

We are registered in Spain as EU citizens. Currently the UK authorities say that Residency Certificates and cards are valid, however Spain is intimating that they could ask that UK nationals make an application to replace the present residency certificates for the new TIE . At the moment it is not totally clear, but anyway there is likely to be a term to change our status if required.

The current joint report says that to obtain status in Spain, those already holding a permanent residence document issued under the EU law at the specified date will have that document converted into the new document (TIE card).


Summary.

If you are living here and do not have a residency certificate or card you should apply for Residencia (TIE) now. Do it before the January 2020 trigger date, when they can make things a lot more difficult for you.

Currently, we understand EU citizens applying to become a permanent resident in the U.K. need tap their passport against their phone, answer 3 questions and pay £6 to cover postage. The process is than entirely automated and extra information is only requested if their social security record etc does not cover the full 5 years.

If you are Resident spending more than 183 days per year in Spain, then the advice of the British Consulate was that you should get your TIE and your padron (being registered on the electoral roll) now. We can help you with this. 


The Halfway-housers

One big problem everyone is aware of is that there are many people from the UK who live between the two countries.   For example, some British residents spend up to six months a year in Spain and don’t register themselves with the local authorities, which could mean they don’t meet the requirements to qualify as permanent residents.  They could find themselves with problems with the amount of paperwork and legal requirements if the final withdrawal agreement is very strict. Additionally Spain may start to match what the UK is doing in terms of applying to become a permanent resident of the country.  People really need to be legally Resident where they are actually Resident according to the law.

If you are here for a total of 183 days (not consecutive) then you are classed as being a resident of Spain. You should be getting your Residency (TIE now), your padrón and a SIP card (Health card) or private medical insurance, and investigating paying taxes in Spain.  If you are living here permanently but as a non-resident of Spain still going back to the UK for hospital treatment, driving the UK registered car etc. you are likely to find that this situation cannot continue.


Requirements for spanish residency (TIE)

Requirements change depending on your circumstances. As a pensioner, an early retiree or if you are working in Spain, there will be different documents needed.

In the Orihuela Costa these are currently:

If you are not working and nor a pensioner in Spain to apply for TIE you need;

  • Your NIE
  • Tax number for Spain (or it will be done at the same time)
  • The form S1 from the UK Overseas Healthcare Team on +44 191 218 1999
  • Passport
  • Padrón (no more than 3 months old)
  • Single amount in bank for last 3 months 9000 euros/joint 12000 euros
  • Private Health Over for 1 year

If working, you need evidence of you working in Spain

  • income after tax of around 850 euro per month into your Spanish bank account, with evidence it has been paid in for 3 months
  • Valid signed work contract
  • Payslips
  • SIP card

If you are from the UK and are currently living more than half a year in Spain, consider whether your paperwork is in order pre-Brexit. We can help you obtain Residencia (now TIE) and a Padron.

    We are retired with pensions.
    My question is we have no health insurance as we are now in our 70s.
    We would like to get the Spanish medical card, but have been told if we have a uk.medical card we can’t have the Spanish,But now we live here full time we need the card, what do we do please?

      Good Morning Doreen,

      If you are from the UK and receive your state pension, you can request an S1 from the HMRC which will alow you to have full medical cover here in Spain and also back in the UK should you go back for a visit and need medical assistance. The other option is to apply for Convenio Especial, to apply for this you have to have been resident in Spain for over a year.     How do you count the 183 days in the UK and Spain when Spain ‘s year is Jan to Dec and the UK is 6th April to 5th April? You can end up with more than 183 days in both.

      If you are a Spanish Resident and are in Spain 183 days from January to December, Spain will look for you to pay your taxes here. The tax office will not take in to consideration the UK tax year. We hope this answers your question.

    Hi,
    We bought a property in Calpe last year and plan to move to live in Spain from next year.
    We are, and will continue to be employed in England and paying UK tax but we will work for our companies from Spain.

    Please can you tell me if we need to apply for residency in Spain and whether or not we can get a health card?

    Also, if we are residents of Spain with a health card does this mean that we cannot then use UK healthcare when we go back to England ( we have a proper yin England)

      Good Morning Paula,

      If you intend to live in Spain more than 6 months and 1 day of the year, you should apply for residencia. It would be best to speak to a Fiscal Advisor in regards to your tax situation before hand as you should also be paying taxes here.

      As you would be paying your taxes in the UK at the time of the residencia application you would get health cover from the UK in the form of an S1, this can be obtained from the Inland Revenue. This may change after Brexit.

      It would be best to check your UK health cover,when in the UK, with the NHS or the Overseas Health Cover team at the HMRC.

    Spain says I am tax resident, but so does the UK!
    DTT rules say I can’t be tax resident in both, so who do I need to fill in a tax return for?

      As you live in Spain and your family are based there, you should be tax resident in Spain. Whatever UK tax you pay from your salary will be offset to your tax return here in Spain when submitted.     Hi,
    I currently live in the UK and want to move to Spain in the near future with my family. I am tied to the UK because my father is living with severe dementia in a care home however my wife’s parents already live in Valencia region. If, 1st January 2021, UK citizens are expected to earn £20k+ to meet minimum income rules as non-EU then I know we wouldn’t qualify to claim residencia. I’d like to know how quickly we’d be able to claim residence if we were to move across in the summer of 2020 please.

      Hello Pete,
      My advice is get it done now. Yes, we have until December 31st but after Feb 1st the floodgates will open with British people moving to Spain.
      Also, i think personally ( I am not an expert) The Spanish government will give Brits another year (ie the whole of 2021) to get legal residency, but that’s just a hunch and goes against my main advice which is;
      Allow Spanish solutions to start the residency process right now! There is no advantage to waiting!

    My son has lived in Spain since the late 1990’s when the whole family moved to Mallorca and I bought a business and we all worked there until my wife and I sold out and returned to the UK in 2010. I am a retiree and have a UK and Spanish pension. My son is going to start a business soon and I wish to join him, initially for 3-4 months to assist in setting up his business. I had Residencia and I am wondering if I could reinstate the Residencia as I’m in the Spanish Pension system? Also, would I have to become an ’employee’ if I am just assisting him voluntarily?

      Hello Colin,
      Congratulations on the new business.
      Yes, if you are working for your son, I mean if it is a shop or a bar or something, you very much need to be an employee. You’ll get as fine if the inspectors come in and you are standing there, without a contract.
      If you are working from home as a consultant, that is a different thing.
      Why become a resident though? Your son can pay you for 10 hours pw, for example or whatever you are doing, and once your three month helping out ends you can decide then what to do. You may love it and want to come back or the opposite!
      Spanish solutions can help your son with the business set up, work contracts etc.

    Could you please clarify if, as a Spanish resident, I am liable to pay taxes on income earned in Spain only or on income earned worldwide? Also,is it correct that UK citizens have now until the end of 2020 to apply and finalise residency permit?       Yes, if you are resident in Spain you are liable to pay your taxes here, if you are in the country more than 183 days per year. If you declare you are not, the tax office may ask for proof of this.

    I have a military and state pension, which are taxed in the UK and I am resident in Spain. Last year over 2000 euros was removed from my bank account for a tax on my state pension? I have been informed that this has been backdated to 2014 and will continue until up to date and beyond. The Spanish use my military pension add the sum to my state pension and that produces banding for them to then tax the state pension! The double taxation agreement between the UK and Spain states that Military Pensions are exempt and where taxes have been applied they will not be applied again in the resident Country. How can this happen and how can it be backdated?

    Hiya, I am a freelance writer and can work from anywhere. I invoice my clients from my UK sole trader company and pay my national insurance / tax in UK by self assessment every year. Pre Brexit I would bring my caravan down to the south coast and stay from November to March and the length of stay was never an issue. I don’t want to be in Spain for more than about 4 months of the year, but if I buy a modest little scruffy village house inland Costa Almeria for say £30k to live in during those winter months, will the 90 day per 180 day period Schengen rules max stay preclude me from doing this?

    Is it possible to get residencia on the ‘have enough liquid funds and private insurance’ basis so that I could stay for say 120 or so days at a time? Or can I just continue to come for up to 4 months at a time and not have to do any paperwork than I do now (apart from UK green card vehicle insurance and get an international driving permit)? Thanks.

    I have a Residencia but it’s only 10 months old. I know those with permanent residency, which I assume means those with more than 5 years residency, will get permanent residency in Spain but what about those with less than the 5 years?

    Can you obtain residencia in Spain without being or becoming tax resident? I have owned a property in Spain since 2006 which I have used as a holiday home / second home, living primarily in the UK. I am on the Padron but the question of residencia has not arisen as I have never been in Spain for a continuous period of more than 90 days. However I had hoped to retire to Spain in a few years time and I am worried about losing my rights to reside in Spain ollowing Brexit.

      Good Afternoon Stephen,

      If you are not locating to Spain for a few years, we would recommend waiting until then. We would not recommend becoming resident if you do not live here at the moment as when you become resident in Spain, you state that Spain is your home and your fixed abode. You would also be liable to change your driving licence to a Spanish licence.

      You can be resident in Spain and not pay taxes, if you are out of the country for more than 183 days of the year, but the tax office can request proof of this and if they are not satisfied with your evidence, you will be liable for a large tax bill.

    I have a yacht in Torrevieja Marina and spend from September to March (7months) here living on the yacht and some of the time sailing Spain, France and Italy.
    I come to Spain in my UK registered car, normally by ferry from Portsmouth to Santander, this is necessary to bring my dog with me.
    What will my status be after Brexit. All my property and business interests are in the UK. I do not wish to be resident in Spain ( I was resident for 15 years ending 2011 and have a Spanish state pension)
    My yacht is UK flagged. would it be better under a Dutch flag?

      If possible it may be best to register your boat under a different flag but you would still hold a British passport.We would recommend discussing this with the relevant department, where your boat is moored. We are sure they will have been asked this question many times.

Overall we spend approx 3 months over the year in Spain.     Congratulations on a fantastic site, so helpful. Like many people we own a property in Archidona, the idea is that we will spend 2 months or so at a time in Spain but no more than 6 months in a year as we move towards retirement. Naturally we pay local council tax on the property and have NIE numbers. It is possible that we can get Irish passports. We will not be looking to work in Spain, nor have any claim on any Spanish state benefits, we would also arrange private health care. What would be our position post 2020, should we apply for residency?

We spend roughly 8 months each year in the UK and 4 in France. However, my brother (British born but now a Spanish resident) wishes to sell me a small property that he owns in Spain.     Hi, fantastic article, many thanks. Just two follow up questions. I am in Spain in a holiday let, looking for places to rent to permanently move to Spain before the end of this year. So naturally, I’ll want to qualify for residencia. I’m very early retired (40s) and have sufficient funds I can put in a bank account. TransferWise have said I can indeed use them as my Spanish bank account, even though they are UK based. Does it have to be a Spanish bank for residency, or is TW fine, do you think?
    Second question is about let periods. A lot of the decent rentals are being snapped up already, and I’m running out of options. So I’ve found one nice place but the rental only runs from this November to March next year, while another place a few doors along will be available from the March onwards for more than a year. They are classed as long term let’s, not holiday only lets, but still – if I had to return to the uk this summer, do you think I would be able to come back as late as November and have my residency appointment that same month and gain it if I was renting in bits like this (5 months here, then potentially longer in another place)? Or would I need to show a single long term let? And could I even begin from November? Or would I instead need to have been in Spain for x number of months before applying for residency?

      If you intend to stay in Spain for more than 6 months of the year, we would recommend applying for residencia. To apply for residencia, you have to be living a minimum of 3 months. The Foreign Office will ask for bank statements to prove this. To apply for residencia, you also have to have a permanent Spanish address, if you move from rentals every 5/6 months, there will be no problems. Please note this is the requirements for residencia pre-brexit, we are unsure if there will be changes now brexit has happened. We hope this helps.

If you are not in the country for more than 183 days but your family are and Spain is your fixed abode you should pay taxes here.       As your wife is non European, the process for residencia is more complicate but is possible.

      Firstly, your wife would visit Spain on a visa, which can be organised before she travels from via her local Spanish Embassy. When she is in Spain, she can apply for her residencia within her 90 days visa.

      We would recommend contacting a Solicitor or Gestoria in your area, who specialise in residencias for non EU citizens and ask they help you with this, we hope this helps.

    I was a resident in Spain with all of the official documents (NIE, Cat Salut, Padron etc etc) and was working in Spain until July 2019 when I moved back to UK (because of the health of my mother) – I still have all of these documents and an open bank account there, and I plan to move back as soon as I can (but I’m currently working in the UK). As I already had these documents does this help? Or because I am currently working in the UK it won’t make a difference?

    Hi there, fantastic website have found lots of information that I simply cannot find anywhere else! My partner and I both uk residents and citizens at the moment purchased a house in December 2019. We have NIE pay taxes and utilities etc. We are wanting to move in this year but I’m getting baffled with the residency side of things. We both work full time in the UK at the moment so can technically prove EU income and savings which is all in sterling currently. My concern is that we do not get many opportunities to fly to Spain at the moment, can I apply for residency here in the UK. I have emailed the consulate but again not getting any solid answers. We also won’t have an income initially but will after say 3-6 months in Spain. What do I need to apply?

      To become resident in Spain you have to be living here for a minimum of 3 months, the Foreign Office will ask for bank statements as evidence of this. You can not apply for residencia from the UK, it has to be done in person.       We would recommend waiting until you are ready to settle in Spain for 6 months or more before you apply for residencia. When you apply for residencia you state that Spain is your fixed abode, you will also be liable to pay taxes here and change your driving licence to a Spanish licence. You will be able to apply for residencia post brexit but what the requirements for this have not been confirmed as yet. In regards to tax, a Fiscal Advisor would be provide tax information based on your personal situation. We hope this helps.

    My family wants to move to Spain in 2021. My wife and the two children (My stepdaughters) are all spanish nationals. But have all been living here in the UK for several years. My question is can I apply for residency when i get to Spain in 2021 on the basis that my wife is a national (i.e. her EU status will allow me to “piggy back”) . Or is it better for me to go and spend three months in spain during 2020 and apply for residency to be on the “safe” side? But this would be far from ideal, as you can imagine!

    Hi, we hve been living in Spain full time for the past 10 years, and we have, as far as we are aware done everything to move our life over here. Padron, Residencia (converted to perminent) Spanish driving licences and taxes. So we think we are well placed for the future. However, the piece on automatic change over to what we assume ar TIE gives us, and I suspect many others, a certain amount of worries. To my shame I did some pretty criminal things in my teens, although I am please to say I have been law abiding for the last 45 years. The worry is what does criminality check mean. Criminal activity can range from drunk and disorderly to murder. Are there any guide lines. PS I did not commit either of the aforementioned crimes.

    Property in Spain since 2012 (not mortgaged) in my sole ownership; husband a pensioner (71) but I still have another 5 years before I get my pension. I am obtaining Irish citizenship but this takes 9-12 months as had to track my long lost Irish grandmother before I was able to apply. Wanting /was hoping to retire to Spain when I too get my pension. Have a property here in the UK valued around £250,000 which we would either sell, let or downsize to free up funds. We wont have £20,000 income each pa but might have a sizeable lump sum if we sell or downsize in the UK plus our pensions to be able to support ourselves financially. Would this be sufficient to enable us to move to Spain and get residencia post Brexit (when the UK has officially left the EU) and would my Irish citizenship be of benefit in applying then please?

Have signed 6 month rental contract from 30 November 2020 until 25 May 2021 (just short of 180 days to remain uk resident) in spain for long holiday not working. Due to brexit would I only be allowed to stay 90 days now please and should I change contract to 3 months or wait and see if transition period ending 31 December 2020 is extended please? If can only stay 90’days would I be ok to stay until 31 March 2021 as would 90 day rule start 1 January 2021 as I will arrive in spain before end of transition period? Landlord happy to change contract term but wanted to give them fair notice if have to shorten length. Thank you so much if can help as very worried about this

      You could take an initial 3 month contract, this will give you flexibility and reduces the risk of you losing any deposit if you need to end the contract early. At the moment, there is very little concrete advice to what will happen at the end of 2020, we are sorry.

    My son is British and works in England and pays his taxes in the UK. His wife is Spanish, works and lives in Spain with their 2 children in their owned house. My son travels weekly to UK to work. He is in the UK approx 190 days a year and in Spain the rest of the time. Would he have to take up Spanish Residency to continue to do this. Or will he be able to continue as he is as a British Citizen.
    If he does have to take up Residencia are there any tax implications that could affect him?

    I own a property in Spain , but am unable to be resident there before the deadline as I have a business to sell and don’t envisage it being sold quickly. My question is , in the worst case scenario and UK citizen’s are treated as third country nationals. What would the requirements be to become permanent residents ? I can find plenty of information on the annual financial requirements , but nothing on having sufficient funds to keep myself. My situation would be , my husband and I would have funds of approximately 375,000 Euros , but no annual income ( I was going to use this to buy a business) but the profits wont meet the annual income requirement. So really would this sum of money be deemed sufficient by the authorities to live on to gain residency?

    Hi. We are just about to complete on a property in Murcia that we will use ourselves as a holiday home. We will not be renting it out at all, it will be for our private use. We are currently working in the UK, full time, so will likely visiting for long weekends or a couple of weeks here and there.     Me, my husband and 18-month old daughter plan to move to Girona end of April 2020. My husband works remotely and his company (although not Spanish) are registered in Spain, so he will be paying Spanish taxes. We are British citizens, but currently living in Amsterdam. I am eligible for an Irish passport, which means I will still be an EU citizen. However, I have no fixed address currently, so can only apply for the passport once we are settled in Spain. My husband is not eligible for an Irish passport, but my daughter is. Will having this passport make things easier for us with regards to getting a residency? Thank you in advance for your help.

      If the caravan park is oficial, then you should have no issues. It may be best to check with the office at the caravan park and also the Padron office to ensure there will be no issues with the documents required for the padrón. The padrón confirms your address for the purpose of the residencia. If you can get this, there will be no issues with the residencia (confirming the rest of your documents are correct). There are no updates, at all, in regards to the changes after Brexit, we are sorry.

      As all Brits will have to renew their residencia and apply for a TIE (tarjeta de identidad de extranjero) shortly, we would not advise changing the address on your residencia. To update the address on the residencia, you have to go through the same process again. We have no information at this stage on the TIE or to the process, as soon as we have any update on this we will notify all customers via a blog and a news letter.

    So my situation is possibly a little different to most.
    I have been working in Gibraltar for many years now and live in Spain; in the province of Malaga. When the borders closed due to Covid-19 all cross-frontier workers were told they could apply for their residencia through the local office in La Linea. There was a notice placed inside the wondow of the police station with all the requirements. I went to my appointment about 10 days ago and met all the requirements other than the new requirement that I don’t live in the area known as the Campo de Gibraltar and would have to book an appointment in Malaga city. I have now been advised that the city of Malaga do not recognise cross frontier workers and that I would now have to go down the route of minimum bank balances over a period of at least six months. The documents I presented initially were more than sufficient if I lived in Cadiz. I thought that the rules were national requirements and not determined by individual provinces? Obviously I am now getting quite concerned as if I am unable to get this residency it will mean I will not be able to cross the border and may be in danger of losing my job. I am just seeking clarity on what my options are now; other than moving to La Linea which is not really feasible for me.

    I’m planning to move out to my owned property in the Cádiz region in Mid July 2021. I will be withdrawing 25% tax free from my pension whilst being a UK tax resident in both the 2020/21 & 2021/22 tax years since I would have worked for more than 90 days in the 2021/22 UK tax year.
    Since I will be moving mid July 2021, I presume I will not be required to advise the Spanish tax authorities of my pension money because I will not have been living in Spain for six full months?
    Would this be correct?

      Dear Ross, Thank you for your enquiry. When you take Residencia you should also become a tax resident of Spain and also register for Spanish healthcare. All different steps. Then you would be de-registered in the UK as you cannot have both in both countries. With regards to tax, you will need to contact an accountant for advice for your particular situation closer to when you come over. With regard to the 8,000€ in an account for Residencia, this was the case local to us before the offices closed during the lockdown (they are still closed) but they are not open to ask at the moment. If you are based close to us please contact us around the end of June to check the requirements once they reopen. Kind regards

    Hello my husband and i were planning to visit Spain on the 29/03/2020 to look at some properties in Puerto de Mazarron with a view to buy one and move there by by the end of this year. Due to the corona virus we were not able to do this and since then the buyer for the the property we were selling in the Uk has pulled out, From Monday 11th May the estate agents in the uk are up and running again and we hope to start viewings in the next few weeks, Of course we are still not able to travel to Spain and are now thinking of going strait there after we have sold as soon as we are allowed. I’m worried though that we might run out of time to get the NIE and NIF card before 31st December 2020. If we get the application in before then,will we still be eligible after 31st December? Also my husband retires in January 2021 how ever I don’t until 2023, i would like to work out there but if not we would have enough savings to last us until i retire. Would that be allowed? I understand the he would be covered by the Spanish healthcare once he is retired but i would need to have private healthcare until i retire or not if i become employed? Many thanks kind regards A.       Thank you for your web enquiry and I am sorry for the delay in replying due to volume. At the moment it is not clear what is going to happen with Residencia (which I think is what you mean as NIE would be simple to obtain). Once their offices are open after our State of Alarm ends, you should be able to get an office local to Mazarron to assist you. It is too early to say what the rules will be and we do not know them for that area I am afraid. My recommendation is to follow CAB Spain’s posts as they will be very useful for you.     Different situation than the majority I’ve read here which you may be able to offer advice on. I have been commuting between Spain and the UK for several years now. I am passed pension age but don’t have a pension. I do however have a UK limited company where I employ myself. I also have a child here in a private school here in Spain.

    My wife has her own property in Spain and has residency in the country and indeed when I am in Spain it is where I stay. In fact I arrived in Spain this January prior to the pandemic and am still here. It also seems that as a British passport holder I’m unlikely to get back in Spain anytime soon as a result of the travel restrictions, which is an interesting dilemma to say the least !

    My questions really relate to residency. Am I able to apply in the current situation as a pensioner, with a family here, with UK income but no pension. I have private medical insurance in Spain and have had for a couple of years.

You can only apply for residency in the local area in which you live, which I am not sure whether that is close to us. It differs in each area the situation, and is in a fluid state At the moment the offices are closed, so we are unable to process Residencias but we hope to soon.       As things stand, the situation with Brexit could become very difficult. If anyone tells you they know whats happening, be careful of taking advice from them.
      We were absolutely certain, before Covid 19, that there would be no hard Brexit but now the chances of this are increasing.
      Negotiations between Spain and Britain have stopped during the lockdown and the UK government says it is not applying for an extension to the Dec 31st deadline.
      What i can say for sure is that you are currently a European citizen and therefore eligible to apply for residency in Spain- after the cut off date, who knows??
      My feeling is get to Spain and make the application ASAP,

We plan to apply for residency when we move out there, but we are wary of the time limits with the transition period ending at the end of the year.       What a difficult situation we’re now in. It appears that London is prepared to go ahead with a no deal Brexit and if so, you need to apply ASAP for the paperwork.
      As it sits right now, you need to be here in Spain, spending money and showing that your intention is to actually live in Spain. (not just use it as a holiday home).
      When you’ve done that for 3 months and only then, despite the fact you own a property in Spain already- We can take the application further.
      There is a better chance for you, in that you have property in Spain already, but it is a delicate matter and we need to be careful.
      We’ve seen people apply directly for residencia without us, and get turned down!!

      Indeed it is very confusing. Had things been different over the past three months I’d have said that there will be an extension in place from December 2020, now it is very up in the air.
      Can you not get here a little earlier and apply for your residency sooner? That said, you cant even apply right now anyway- You are correct, confusing!!
      The rules say that you have to be living in Spain for 3 months before the residencia application, The Foreign Office look for movement in your bank accounts other than bills being paid.
      Pensioners also have to have their pension paid into a Spanish bank for 3 months.
      The Foreign Office wants all relevant documents as near to the appointment date as possible, if not they may well reject your residency application.

      The cheapest, quickest and easiest way to find the information is to employ Spanish Solutions. For a provision of fees of say, 100 euro plus VAT we can contact the foreign office on your behalf and find out where you stand.
      Your padron needed to be renewed every two years and the likelihood is that the residency is expired too.

      Have you applied for your residencia already? Please be careful about the three-month wait before you apply- there is no getting around this, as explained in many of our replies to clients.
      Once you are a European citizen you have the same rights in France as you will have in Spain when it comes to access to health care. It will be the same then as it is for you now, pre-Brexit.

    Hi there, my situation is a bit weird and can’t seem to find any advice online. I spent 6 months living in Granada last year where I met my Spanish girlfriend. She is still living in Spain as she is completing her studies (which have now been delayed due to COVID through 2021). I have been flying out to see here every month (with the exception of the last few) and I am planning on moving to Spain to continue living with her, but this will likely be after Brexit due to the nature of my contracting work.       Hello Sam,

      We are used to dealing with “weird” cases so don’t worry. Your situation is not too serious and easily fixable.
      The Pareja de Hecho is a good option but getting married ( I am talking from a legal point of view in Spain) always provides an added layer of protection.
      With the “Pareja de Hecho” you must make sure it is registered properly and if so, you will be “almost married”.
      We had a recent client who signed a Power of Attorney to Spanish Solutions and we did the marriage in the notary on their behalf. That is a simple way to fix your issues.

      The answer is not very romantic but to make it easier for your partner to get residency in Spain, you should be married and then request her residencia with the same documentation you requested your residencia + her documentation.

      So, you cannot apply for residency in Spain while living in the UK. You need to get here and prove that you’ve been living in Spain for three months before you apply.
      We think you should not lose your attendance allowance but we will need to check that out before I can confirm.
      There is enough time, as we have six whole months.
      Regarding the COVID 19- I think you are better off in Spain than in the UK. Rates are currently lower here and self-isolation is easier too.
      As soon as you are ready, we’ll help you start the process. If you can’t make it to our offices in Pilar de la Horadada or La Zenia, that is ok- we’ll go to meet you. (with social distancing)

    Hi I’m looking to move to Spain permanently but I own property in uk which I rent for income my husband is self employed and is hoping to go self employed in Malaga area where we plan to rent for about a year to try Spain out with hope of buying a property for ourselves to live and work could you advise can we go to Spain stay there for 3 months then apply or can we leave uk and apply get the residency then come back and forth with our belongings
    we can provide proof we can sustain ourselves and need to know all documents we need

      Hello, Ann,

      Two answers- Yes 2020 is easy to get residency in Spain for British people.
      2021 is a whole different story.
      You absolutely should apply for your residency in Spain right now or as soon as you can. You need to be living here for three months before you can even apply.
      Are you sure about moving to Malaga? Have you considered the Costa Blanca?

      You both should apply for your residency.
      We think despite the Brexit that there will be mostly fairly easy movement between Spain and the United Kingdom. Travelling over and back will be ok, as far as we can see.

    Both myself and my wife work for a UK company (that we own) but have residencia in Spain because we spend more than 90 days per year here. We travel backwards and forwards quite a bit between the countries. The amount of time in each country will vary each year, possibly across the 183 days. We do tend to spend more time in the UK though. We average 120-140 days in Spain per year. Would be be classed as U.K. or Spanish tax residents?

      If you are a resident of Spain, you pay your tax here. This is by far the easiest way to operate, especially with Brexit on the horizon. Due to the tax agreement, you only pay tax once, not twice (i.e. in the UK and Sapin)

    My wife and i are retired and have lived in Murcia region since 2007. I am 70 and my wife will be 65 in Sept. We both have Residencia. We both are registered on the Spanish national health system and have health cards. I have a form S1 but my wife doesn’t as she piggy backed on my application although she is not named on the form. She won’t qualify for a UK pension until Sept 2021. She has no income but is registered with the Tax office and we submit a tax return yearly. Does my wife need to have an S1 certificate?

      Your wife needs to be a beneficiary on this s1 form. She needs to certify with a marriage cert that she is indeed a family member then she is fine.

      You’ll be here over the Brexit date, December 31st, but you should be fine.
      A holiday in Spain for three months is perfectly fine, and well deserved. Any more, considering Brexit, is not so good. (Residency and taxes)

We have another son now so if we was to return next year after brexit how would we go about getting our baby residencia?     I have an Irish passport and my wife has a British passport and we are planning on buying a property in either the Seville Province or Cadiz Province and moving to Spain within the next few months. However, we are not pensioners, won’t have jobs but will have a sum of money in the bank after recently selling our house. In order to get residency, I believe that we would need to prove that we have at least €8000 per person to prove that we have sufficient means to support ourselves. If we can meet that criteria, does that mean we are likely to get residency?

She is retired and splits her time between the UK and Spain, she generally comes here for around 2 or 3 months then back to the UK for 6 weeks and so on. She doesn’t have residency and we’re a bit lost with where to start. Does she actually need residency? She stays with us when she’s here, doesn’t have a Spanish bank account…..HELP!

      We start every conversation about Brexit with phrases like “it appears that or in our opinion…. “. this reply is no different.
      You mother is less than 6 months here so there should be no need to pay tax in Spain or anything like that.
      I think she should have a bank account here just in case she decides to apply for residentia.
      Does she have private health insurance?
      Would she consider applying for Spanish residency?
      I’m not trying to sell you on the idea but it could mean a possible tax reduction on properties when she sells or buys in the future.
      Tax reduction on inheritance tax may also be applied.
      It is worth considering.

    I’m in the UK currently and wish to move to Spain with my wife but our UK rented property tenancy does not end until Jun 2021.

    I have 4 questions if you don’t mind and would rather employ the services of a pro throughout once I get going.

    With the transition period looming, this is what I was thinking – we have cats and my wife is in a high-risk category for Covid and can’t fly, so I’d be driving, alone. Trying to mimimise our time apart as much as I can!

    1. Go to Spain, get NIE, bank account and long term rental property.

    2. Live there alone in order to build up 3 months of bank deposits and activity and after 3 months, apply for residencia.

    3. I return home until I my appointment, then go back and be there in person.

    4. After the appointment, end the rental if I can and return to the UK for 4 or 5 months before we both move (with the cats!) for real.

    My questions are:

    a) How would my wife get residency? Can I do this for her without her being there? If not, can she come over just for the residencia appointment?

    b) Can I return home for a week occasionally during the 3 month period that I live there, say 1 week per month?

    c) Does the new TIE change any of my plans?

    d) We are self employed with a UK Ltd co that we wold run from Spain, but pay our personal taxes in Spain. For this, do I need private health care from day 1 and be autonomo registered in order to become resident?

      Hi Simon, If you have an LTD co in the UK, for tax reasons, you should have a company here in Spain. If you keep the LTD co in the UK you must be fiscal residents here. If you pay tax in the UK, and not in Spain, you don’t get the benefit of free health care.
      Sure, you can easily return home for a week during the application process.
      The new TIE does not or should not, change things for you.
      Your wife needs to be here in person really. If this is a problem we can apply for you first, and your wife later.
      To make a more accurate assessment we probably need to speak in person as there are a few points I’m confused over.
      Are you going to buy a property in Spain? Will you apply in 2020?

      Hola Alex, It was an old card? No fine for not renewing- Don’t worry. Simple process, we need to apply for it.
      We tried to get a residencia for a person whose NIE expired in 2008 yesterday as a matter of fact. Please remember the TIA is necessary for British people living in Spain. Saludos, Ana.

      Hello Michelle, Brexit really is a difficult situation for British people living in Spain. The rule of thumb when wondering about residency in Spain is;
      Less than 6 months of living in Spain is fine. If more, you need residency and start paying tax here.

We want to be free to come and go as much as we want, we have spent about 5 months a year in Spain over last 7 years and as well have our main residence in UK we also visit other countries. We have looked at options 1/ my wife can buy and become resident, I can get an Irish Passport. 2/ we both can buy and become resident. In both cases we will have a UK base, and ongoing investments in the UK. How will either of these choices effect our tax situation, I am asking will Spain be tax efficient for me as the assets in the UK can be in my name and in Spain in my wifes?

      Hello Michael. Absolutely, come and go into Spain as you wish.
      Both can buy the property from a tax point of view. It doesn’t matter if it is only your wife on the deeds. Buying a house doesn’t mean you have to be a resident. You can pay a non-resident tax and enjoy owning a property in the sunshine.
      As a general rule, if you spend Less than 6 months here, there is no need to pay taxes on your income. Naturally, you’ll pay council taxes etc plus NRT once per year.
      What part of Murcia are you looking at?
      We live on the border between the two provinces. It is a beautiful area and we feel very lucky with the low infection rates we’ve seen here from the COVID.

      We are all wondering what the situation will look like after Brexit.
      My amateur advice is to get your home sold in the UK as soon as you can. The money you’ll lose on the drop in value there, we can help get you back by getting you a deal on a property in Spain. Act now though as it looks like the recession in the UK after Brexit could be long and deep.
      The s1 is a european document but as the UK will not be part of Europe in 2021 you will not be able to get one of these.
      If you are definately coming to Spain, I think you should apply now in 2020 for the residency card.

    Hello. We live in the UK and have owned a second house in Spain since 2007. We pay our non resident taxes, SUMA etc. Since we only use the house for holidays, my Mum stays out there for months at a time. She is on a UK state pension and comes back to UK see doctors etc. She certainly would want to continue to stay for more than 3 months in a block over winter. Can she still do this without applying for residency ? She is really worried what will happen to her life as she has been able to stay in the sun for as long as she desires. Will the authorities really deny a old lady entry back into Spain if she stays for more than 90 days at a time?

      Brexit is really not kind to people like your mother!
      We have no definate plan yet, although that is hard to believe with the deadline just months away.
      The Spanish authorities will check how many days your mother is in Spain for- they simply scan all the non EU passports. If she is here for more than 183 days, she will have to pay tax here.
      Is that worth becoming a resident then? Of course I think it is, but you’ll need to work it out for yourself and your mother. Will she have a better way of life in Spain? The medical care here is excellent, and it is easier to stay healthy in such a favourable climate.

I am British and have been living and working in Barcelona since 2009 and have 3 young children all born here (my husband is Colombian and my children have British passports). I have the green NIE card and my husband has the NIE card which says he’s a family member of an eu citizen. My question is do I need to get NIEs for my children before the deadline? For my youngest the social security is asking for a NIE in order to register them as my dependent. This seems like a new rule. I have been trying to get a cita previa with extranjeria for about a year now with no luck as there are no citas. And now with the pandemic it seems it must be even more difficult to get a cita.

      In my opinion you should request residencia for both your husband and your children. The Green card you have is more likely a residency card?
      Remember you are an EU citizen until the end of 2020 so now is very much the time to act!

    Hi, I’m trying to understand tax/benefits situation. I want to move with my family next year. I work online, with clients from all over the world.

    As I understand it, I’ll have to pay tax on all of my income; but as I see it, I will receive almost no benefits; so if I make, say, 100,000 Euros, in 2021, I’ll have to pay approximately 40% of that to the spanish state… But that seems crazy – I have to pay for health insurance to get the residency, so that means I woudln’t even get health cover. As I gather, there’s no child benefit, no tax credits, no other benefits.. Am I really reading correctly, that I’ll have to pay 45% tax plus state benefits, plus private healthcare insurance for the privelage of living in spain?

    Surely I’m missing something, right? coz I’d love to raise my latino kids in Spain; but that seems to be an ungodly price to pay. What are other digital freelancers doing, other than skipping out the country every 6 months? coz I can’t believe other sensible people will pay so much for some nice weather and food.

    Clearly, I’m going to talk to a tax advisor about options; but if you can just clarify if there are means of not giving up 45% income + state taxes, for digitial freelancers, that’d be of some assistance.

      Totally I understand the tax situation in Spain but remember if you were living in the UK, you’d have to pay your tax there anyway. You only pay once, ideally here in Spain.
      The advantages of relocating to Spain are not from a tax point of view but from a way of life point of view and a cost of living perspective.
      Doing your work from a laptop on the beach will, i hope, ease your tax burden!

      The answer is Yes; if you are thinking about retiring in Spain, you will need your residence card in Spain. Residencia is the most important document you have if you are moving to Spain for more than three months.

      Your Spanish residency can be:
      Short term/Long term/Permanent.
      The procedure to apply for your Spanish residency varies between European Union and non-European Union countries.
      Right now, (july 2020) The UK is a member of the EU, but this is changing as we all know.
      Our advice is to apply now, while we know the rules and start to enjoy your retirement in Spain!

    Good afternoon. I am a British citizen resident in Spain and I am completing the EX23 form to apply for a new Tarjeta de Identidad de Extranjero (TIE). The form requires my name and two surnames = but being British, I only have one and my passport does not include my mother’s surname. What do you advise me to do: leave the second surname field blamk, and also the firlds with the give names of my parents (thus making the form consistent with my passport), or to fill in the second surname field with my mother’s surname, which doesn’t appear in my passport?     Good evening. My excuse for repeating myself – I thik an earlier comment of mine has got lost. I am a British citizen resident in Spain. In completing the EX23 form to get the Tarjeta de Identidad de Extranjeros, should I simply use my surname (which is my father’s surname) as in my passport, or add my mother’s surname which is not in my passport or any other fficial document? The EX23 form has two firlds for surnames, and requires also the given names of both parents – which is fine for people from the Spanish world, but not for foreigners who normally have one surname only.       You should use your name as per your passport. For your mother and father it will be their first/Christian name you should use. You do not require to use 2nd field.

    My wife and I are in the process of selling our house in the UK with completion approximately at the end of September. Due to a surgical appointment we cannot move to Spain until just after 20th October. We initially plan to rent a property and apply for residency before we move the majority of our money to Spain in case we are unsuccessful with our application. Our plan is to retire early and self fund our retirement from the balance of our property sale, my wife also currently receives ESA and PIP, I believe she will lose the PIP but can retain the ESA if we are resident before 31st December. We have a friend in Spain that works for the Spanish National Police who has offered to help with our application although they live in Madrid and we plan to move to Costa Almeria. As the timeframe from our arrival and 31st December is under 3 months is obtaining residentia a real possibility or a non starter?

    Hi, my wife is a computer programmer and has been told working from home will be the new normal at her company forever. She has been learning Spanish for several years and is keen to live there one day. With deadlines approaching she is considering moving over for several months to get her residency before 31 December. The card is a temperate card without photo ID, therefore, how long is this card valid for and when can i replace this temperate card for a proper photo ID residency card?

    Secondly, I have a property in the U.K. I took residential mortgage, since I left I rent it to my cousin, do I pay income tax on this income? I pay income tax in the U.K. for this, do i hace to pay tax again in Spain now that I’m a tax resident? And when is the deadline if so please?

      Yes this is your residencia card and at the present time no rush to change to TIE, further detail on dates to have changed may be announced over next few months. You will require to do a tax return this year if you became a fiscal resident last year, and will be due tax on worldwide income. We are both semi retired and pay our taxes in UK and would like to continue with this arrangement as we have other assets in UK and would not like to become a Tax resident in Spain as well as it will be too complicated for us.       You can apply for residency and if less than 183 days in Spain would not be fiscal resident, although tax office may ask for lots of details to confirm that. If you are not resident you can only spend 90 days in 180. Initial residency is valid for 5 years then can be made permanent, healthcare is dependant on whether you are in receipt of State Pension.

    Hi I have heard so many different things so I wonder if you can help. I have a house in Spain and not one in the UK. I haven’t been a resident up to now and know I need to be one if I am wanting to be in Spain more than the rolling 90 days. I work from home self employed for a UK company and earn less than the UK tax threshold. I will also have a private pension of £72 a week starting from December. I am 56.       You would require to contact a fiscal advisor to go through your tax. There is no minimum for autonomo. Your residency application will not be any different due to your son being resident.

    I am a UK born resident. My husband is Spanish with a Spanish passport. He has not been resident in Spain for 25 years and has indefinite leave to stay in the UK. We want to move to Spain, retiring early with a view to buying a property or at least rent to begin. Or does owning a property make a difference?Can we still do this post January 2021 brexit date? Or should he move there before January 2021 to make it easier? Is there a specific length of time he needs to live there? Could I join him more easily after that date?

    I believe I’m allowed to be out of the UK for 5 years without losing my residency. I ask you this in case things don’t work out in Spain. I am assuming I could return with my husband to the UK?

    I hope you can answer my questions. I find this all very confusing and if I need to move quickly I will.

      It makes no difference to be a property owner. Currently to apply for residency you require to show 3 months of living in Spain and as we do not know what the criteria will be in 2021 it probably makes sense to come out earlier. Now I hear I am entitled to Spanish state medical care with my status so do I still need to have private medical insurance? My daughter got her permanent residency too last year with no issues.     I am really struggling with understanding the changes. We own houses in Spain (Orihuela Costa) and the UK.

    My wife and I currently spend 112 days in Spain between January and May (but come back to the UK for a couple of days in the middle of this period) and then 60 days between August and October.

    My understanding is that this will no longer be permitted because of the 90/180 day situation.

    I understand that we can apply for residency in Spain but pay our taxes in the UK as we currently spend 170 days in Spain but 195 days in the UK.

    We are retired and receive occupational pensions but don’t receive the UK State pension for another two and four years respectively. Because of this can we access the Spanish Health System?

    From what I have read we would have to pay for private health insurance for a full year in Spain. This seems mad as we have no intention of changing our situation in the future.

    Do these changes mean that we MUST buy private health insurance for a year even though we have no intention of living in Spain for a full year?

      What you have quoted is correct as you are not yet in receipt of State pension. As you are becoming a resident of Spain you need to show you have adequate protection for medical conditions.

      At the moment you will become fiscal resident if spending more than 183 days in Spain. Currently if on a temporary resident card you cannot be outside Spain for more than 6 months in first year before residence may be revoked.

    183 days, tax and TIE
    Thank you for putting so much effort into giving us all information.
    What do you advise about our dilemma please?
    We wanted to return from Spain to the UK to get our affairs in order before returning to Spain in October to apply for Residencia. By doing this we would have stayed below the 183 day limit for tax residency.
    But Covid19 and The State Of Alarm meant that we couldn’t leave Spain until June 15th when the borders fully reopened. The Spanish Tax Authorities say that ALL days under State Of Emergency will be counted towards the 183.
    This has left us with 14 days of the 183, meaning that we cannot return to Spain until the end of December.
    But this only gives us until the end of the year to apply for our TIE.
    We have heard that if we apply online with a registered agent before December 31st then we will be ok, but is that true?
    Once our TIE application is made, with that automatically make us Spanish Tax Residents regardless of having spent less than 183 days in Spain during 2020?
    What a puzzle!

      We believe that the lockdown days are not being counted and you will not be fiscal resident in relation to this.     My wife and i are 55 and are currently selling up in the UK to go traveling, retiring early, self funded. We hit our pension age at 67, after which we would like to settle in Spain. We could invest in property in Spain shortly, if it makes any difference, but would not want to settle until after traveling the world in 10 – 12 years time. Would you consider it important that we obtain NIE, TIE etc before the WA ends?

      I can’t reply fully without knowing how long you have been resident as the criteria changes from up to 5 years and above 5 years. On your 2nd question as you are a Spanish resident it does not count towards the 90 days in Schengen area.

I returned back to the UK for a few months during the winter and because of the covid pandemic have been able to return to apply for residency. My parents own property in Alicante region and I plan to go there at the end of the month to apply.

    My wife and I have had a holiday property in Finestrat since 2005, complete with Bank account and NIE numbers, pay non residency tax and Suma!
    While we love Spain, we don’t intend to live there permanently ( for now anyway)!
    My question is can we still use this property for holidays going forward without any reason to apply for residency!
    We understand there is maximum dates we can stay at anyone time, however reading a previous mail you said it was 90 days in a 180 period!!!
    Does that mean three months there and then three months back in the UK and then be allowed back to Spain???

    My husband and I own a property in Spain and currently live in the U.K. My husband has Irish and U.K. passports. He currently works in the U.K. but plans to retire in the next 2-3 years and spend half the year in Spain thereafter. I’m not currently working and want to apply for Residencia. I am a U.K. resident currently but plan to live in Spain for 3-5 months a year and return to the U.K. to work for 2-4 months out of the 7 or so I’ll be there, until my husband retires, when we’ll both spend up to six months (possibly more). We have a bank account and I have Spanish healthcare so I plan to apply for Residencia as people have advised me to before Brexit changes as I will not have the income post Jan 21 to meet the criteria. I will not reach U.K. retirement age until 2027. Can I ask if applying for Spanish Residencia but not Tax residence is my best course of action and if I can be resident without living in Spain for more than 6 months per year? Is this my best course of action?

      We do not know exactly what the criteria will be after Brexit. Currently if you apply for residencia you will become a fiscal resident after 183 days. If within first year you spend more than 6 months out of Spain your residencia may be revoked.

    Hi, currently touring Europe in our motorhome , we left the UK on the 7th July 2020. We are planning on staying in spain for 3 months then Portugal for 3 months, back into France and aim to get home next June ( 2021 ) what will happen with this Schengen rule of only staying for 90 days at a time in the Schengen area, will this apply to us as when we left the UK we were still able to travel without any restrictions? Of course we won’t have any visa, green card etc as these were not required when we set off, will this cause us any problems ?

I can visit Spain to rent a property and apply for residency – but I cannot stay and spend 3 months in Spain before 31 December (I can pay rent/tax/any fees etc. but cannot physically remain in Spain). Is this possible?

    E.g could I fly out now, arrange a tenancy, apply for TIE, and return temporarily to UK? I have around €3000 monthly income in UK but no Spanish bank account or tax status. Have I left it too late to do this ‘legally’ before brexit? Many, many thanks indeed.

    Hello! I’m looking to apply for residencia before UK leaves EU end of Dec. I’ve been living in Spain for over 3 months (Mar/April/May/June 2020) & Aug til present…on a boat not on land! Would this count & be considered towards the 3 months? ie with a bank account & dated receipts from Spanish Marina’s showing entry dates?

    Or do I need to start from scratch with utility bill & a tenancy agreement?

    Also I read that it takes 10 years to gain citizenship & that Spain requires you to give up your UK passport – is this true? Or is there a way to reside in Spain long term and not relinquish ones UK passport?

      To apply for residency one of the documents you require is registered on the padron at your address, you will not be able to get this for the boat. Residency means you are still a UK citizen with a passport.

    Hi, My husband and I are planning to retire early and move to Spain and live there permanently very soon but are not quite ready to do that just yet as we are in the process of selling our business and still have a house to sell. It will be impossible to get this all done before the 31st December but we are obviously aware of the need to secure residency before that date. We are both 7 years away from state pension age but my husband has just received his works pension. We intend to buy 2 properties in Spain one to live in and the other one to rent out, which would provide us with an extra income. Would it be worth us buying one of the properties now and using that to apply for residency and if so, have we got enough time, because we would have to show the 3 months Spanish bank statements before we can apply . So bearing all that in mind, even if we bought somewhere tomorrow with cash, we would still have to wait 3 months before we could apply. What I am trying to say is, Would we still be ok as long as we had made the application before the 31st, even though it hadn’t had enough time to be processed before that date. With the 3 months wait now, we wouldn’t be able to apply until around about the 28th or even the 31st. Would they still allow us the extra time for administration and processing, as long as we got it in by the 31st, or should we just accept we are too late now.

    Hi, I am a UK Citizen who has been living between Barcelona, London and Cape Town since January 2014. I I just renewed my Barcelona apartment agreement on September 1st 2020 for the next 7 years. My first rental agreement was from September 1st 2017. Before that, I was staying in a Hostel in Barcelona. I have a Spanish Bank Account since 2017, but I get paid in the UK and transfer funds to my Spanish Account. I pay my taxes to the UK government since I am paid there, but I do my work here in Barcelona since I work digitally and also when I’m in South Africa. I am here in Barcelona now and want to become resident here. I have been back here in Barcelona since December of 2019. I do not have NIE or Padron, however I do have health records here in Barcelona when I use my EU Health Card going back to 2016. So am I eligible as a UK citizen to apply for TIE? My rent is €1339 per month that I have been paying since September 2017. Can you help me with TIE? Thanks

    We currently live in the uk
    We have owned a property in San Juan de los terreros since may 2017 . We have NIE’s, but we are not on the Padron.
    I am a police officer in uk. I retire next October , 2021. We are planning on coming to live in spain full time around 30th October ‘21.
    As such we have just purchased , or put down, a substantial deposit on another property in terreros, where we plan to live full time . We have put our uk house for sale and our other, smaller Spanish house for sale too.
    I have just been browsing on google , and have seen these articles explaining the requirements for living in Spain (as a retiree) post brexit .
    When I retire I will have no debt. The Spanish house will be paid for in full. No mortgage. However, I will not get the total of 2100-2500euro per month in pension wages . More around the 1400euro .
    I will have savings in the bank . Probably about 80000euros . Have you heard anything regarding these requirements. If so, is it going to be the straight 2300pcm and no accounting of your personal circumstances and the fact you can be self sufficient in spain and not have to rely on financial support from the government ?
    My wife has no income due to ill health and has stopped working this year . Is it still possible for her to apply for residencia if I fund her living in Spain from say November ? Then add me next year . Sorry for all the questions !
    Any advice would be greatly appreciated.

      Applying for residency is if Spain is your place of residence. Without this you can spend 90 days in 180 after Brexit. With residency after 183 days yes you will become a fiscal resident.

    I’m currently still living and working in the UK, but want to join my Spanish girlfriend shortly in Spain (Barcelona). My question is what is the best way to obtain the right to stay in Spain, give the limited time available before the transition period ends. I’d be happy to explore obtaining pareja de hecho status. Is there any qualitative difference from getting residency? It would be a bit difficult to get to Spain due to the current quarantine, so if that could be done remotely that wouod be useful. Any advice you could give would be appreciated. My sister also lives and works in Spain currently, if that is another avenue worth exploring.

I went to Malaga at the beginning of September for a 9 day holiday and I loved it so much I stayed. I have only just returned to the uk this week as I need to help my family out with some stuff. I rent a room at a friends house in Malaga. Although I need to be in the UK for a little bit. Will I be able to apply for residency if I am renting the room but not living there for the full duration of the 3 months? I don’t want to miss the cut off of the end of the year and I know it’s cutting it tight! Please any advise or help you can give me would be amazing.

    Hi my husband and I were hoping to move out to Spain early next year, to buy a property and live there on income from selling our property in UK and redundancy, now because of new rules with brexit we have been told to go now for a week and get a long term rental , arrange a bank account for rent and bills and get our NIE and residecia go to police station for fingerprints and passport with lawyer who will charge us around 600 euros, is this possible and does this mean we can beat the deadline, I’ve been told we can come back to UK after this until we go out Earl next year as planned

      You will need an address to be on the padron. In some areas new padron appointments are not until next year. As you will require to show three months use of bank account I do not see how coming for a week would cover this. You would also require private health care or S1 if you are a UK state pensioner. I would check all of the criteria out with your solicitor before you proceed or make any payment. Hope this helps.

      You will require residencia. I suggest you contact a local gestor to check the criteria for Majorca. You will require to be on the padron and have S1 health cover.

    Hi some great information here I just have a question re tax in Spain. When we eventually move we will have around £200000 in savings , redundancy which will be more than enough to live on until we take our pensions. My concern is will we be taxed on those savings ?

      Without knowing the full details it would be difficult to advise. Certainly any income in form of interest etc would be taxed, or count towards your tax allowance. We can refer to you to our fiscal advisors if you wish.

      If you do not already live in Spain it would not be possible currently to have all the necessary documents to submit and have the application approved in time. We have a white NIE, Spanish mortgage but no residencia.~ which as I understand means right now we are sadly unable to travel to our home. Is there a scenario where we can work/pay tax in the UK but have some ‘registration’/TIE? within Spain allowing us to travel freely to our home?

    My partner and I are waiting to move back to Tenerife, we still have out NIE from before and had lived there for 6 years in employment. We’ve been out the country for 2.5 years now.

    What are our options to moving back? My parents have a property over there, would it make any difference to the requirements if the property was in our name? I’m asking this as the €12000 proven will be an issue for us.

    My wife and I are both retired and receiving a state pension, I also receive a work pension. We bought a Fuerteventura property in 2014 and spend 80+ days prior to Christmas and 80+ days after Christmas in Fuerteventura, returning for the English summer. We have always registered with our local authority and both have DNI/Tarjeta de Residencia certificates and NIE Numbers.
    Since Brexit it has become unclear if we will be able to stay in our property for the same period as as before as although we stay always for less than 180 days it is always more than 90 days within 180 days.
    Could you please advise if there is a way in which we can continue our holidays as before. If this means applying for a visa could you please direct me to where this process is set out. Thank you

We have NIEs, & I am in receipt of a UK state pension, & we have other income & assets. What is the most appropriate option for us to take to enable us to stay for nearly 6 months in GC? We do not plan to work in GC. I look forward to your comments.

      Unfortunately there is no option for your wife as a UK citizen she can only spend 90 days in 180. Sorry but these are the constraints now after Brexit.

    Hi, my parents have a home in Spain, and usually spend winter there, being careful not to overstay 183 days, returning to the UK in summer. My mum has a German passport and dad UK passport. Mum has lived and worked in the UK since childhood and has been married to dad for nearly 40 years, but always retained German citizenship. They are struggling to find any clear guidance on whether or not the fact that dad is married to an EU national means he could stay longer than 90 days in Spain in future. Are you able to advise please? They are financially independent with my dad receiving UK state pension and occupational pension, and my mum receiving UK state pension. Thank you

      As your Dad is a UK citizen he will be bound by the 90 days in 180 days unfortunately. If as a couple they wanted to become Spanish residents then this is when he could use your mothers EU citizenship to join as a spouse.

    Good afternoon, we have recently applied for and received our Spanish Residency (Dec 2020) having purchased a property in Alicante in October 2020. We are now back in the UK and due to a variety of reasons, not least COVID and vaccinations etc. not to mention a slow moving UK house sale, we may not be able to return until August 2021.

    One of our Spanish friends has said that since we will be out of Spain for more than 6 months our residency will expire. Is this true, and if so what would we need to do to stop it from happening. If we came back for a weeks holiday in April (assuming we’re allowed) would that re-start the clock?

      The guidance we have had is that residency may be revoked if you are out of Spain for more than 6 months in any year for first five years. For full clarity I suggest you contact your local Spanish Consulate in UK.

      You can now only spend 90 days in every 180 in Spain. The 90 days for 2021 started 1/1/21.

    I am wondering if you could help.

    I had a NIE in 2009, I have documentation of this in the form of bank statements, bank account documentation and an old work contract. Not the actual NIE document itself unfortunately.

    In 2016 I acquired public liability insurance for a business I had with my 2009 NIE number. In 2019 I was told by an employer I needed to get a new NIE as i did not have my documentation and could not be renewed. I am trying to gain residency and have been told (not from a reliable source but by many expats in Spain) this would have been automated from having my NIE in 2009. Is this the case? If so would visiting the gestoria be the best course of action, although this is where I had my new one created. Also would the old one be wiped by a new application?

      An NIE number never expires, if you have lost the certificate you can apply for a duplicate, or it may be best to contact the Gestoria who dealt with this for you, as they may have a copy on file. In regard to the residencia, if you are a British passport holder, all application for residencia must be applied for, in person, via the Spanish Consulate, please see a link to their website below:

      If you do not have residency status then you will need to apply through the Spanish Consulate in UK. The proof of living here is recent proof such as a padron in last 3 months not from years ago.

    3. What would be the tax implications that we need to be aware of and follow… ?

    4. Our intentions will be to reside in Spain permanently, would this be a problem, and if so, what do we need to do, have in place to make sure we are able to stay… ?

    5. I also read somewhere that a certain amount of savings in a bank account is part of the criteria, which is fine but is there anything else.

    Hello, I have a query in regards to my dad and his common law partner. My dad and his partner are currently residing in Spain in his own house, he has his NIE and residency. He is collecting his UK pension and all seems okay for him, but his partner does not have NIE or residency status. She is not working and they are living comfortably off my dads pension etc. The query is now that Brexit has happened, what should she do to be able to stay in Spain with my dad. They have spoken recently about marrying, but i am unsure if this makes any difference. Residency now appears difficult and she has no regular income from Spain or the UK as under pensionable age currently. She is worried about travelling back and visiting UK that she will not be able to go back to Spain until 90 days have passed.
    What advise would you give?

We do not have a Padron yet or a Electronic signature as we returned to England on the 18/12/20 and unable to travel back to Spain due to travel restrictions.       We understand your concern.

      To enter Spain, you will have to wait until the travel ban has been lifted, as at the moment only Spanish nationals or residents are allowed to enter. In regard to obtaining residencia under the withdrawal agreement, you would need a padron dated 2020 and also at least 3 months Spanish bank statements to show your daily expenditure to prove you “live” in Spain. As you do not have this you have to apply for your residencia via the Spanish Embassy, please see a link to their website below detailing this, visas and the residencia requirements.     My wife and my self are considering applying for Spanish residency in around a year or so, both 60 years old. We have a property in La Romana in Mucia/Valencia district which has no mortgage and valued at 100,000 Euros, an income of 1,500.00Euros per month through private pensions, and equity of £160,000 in property in the UK which we are going to sell if we are successful in applying for residency.
    I have read a lot about the financial requirements needed for residency in Spain, particularly monthly income. Although we will have money in assets and savings I would like to know if we meet the monthly income requirements.

      If you can prove you have lived in Spain before Brexit (December 2020), via a padron and Spanish bank statements showing your daily movement, here in Spain, you can apply for the residencia under the withdrawal agreement. If you can not provide this evidence you would need to leave Spain after 3 months, or you would have a fine which will reflect the length of your overstay. Our first daughter was born here 2.5 years ago and when we applied for her NIE it was the green card for EU citizens.       Your oldest daughter has the residencia which is the green paper. In regard to your youngest daughter, you will be able to apply for her residencia through the normal channels as you and your wife are already resident. I applied for and was granted residencia in November 2020, We returned to the UK to arrange our affairs, however since then we have been stuck in the UK waiting to move permanently because of illness, lockdown, and lack of flights. It looks like we can now make the move in May. I have sold my UK property this month (April). As I have not set foot in the country since November 2020, am I liable for Capital gains Tax on my UK house sale? I am not registered for fiscal residency yet and am still employed in the UK until I leave.

      Thank you for your enquiry and kind words.

      You have to take into account the days you are going to be in Spain in 2021. If at the end of this year, you have lived in Spain for more than 183 days, then you will have to declare the tax return in Spain by the end of June 2022, you would also be liable to pay capital gains on the sale of your property in the UK: And accordingly they should pay capital gains tax in Spain for the sale of the property in the UK.
      The tax year in Spain runs from January to December, and if at the end of this year you have not stayed in Spain for more than six months, you will continue to file your taxes in the UK. Even if you have your Residencis /TIE card.

      Exciting times ahead for you and your family. If the children can obtain their Spanish passports, they would not require any residencia permits or visas. As your wife is British, she would have to apply for her EU/EEA family member visa (then residencia/TIE) via the Spanish Consulate as “married to an EU citizen”. The application would have to be obtained from your nearest Spanish Consulate before arriving in Spain.       The documentation you will have received showing that your application was declined will have the procedure to follow to appeal. Your application was submitted as an individual however, you can apply as a beneficiary of your husband as he has residencia. If you live within the Murcia or Alicante provinces we can assist you.

      Can we ask where your daughter is in Spain, please.

      Your daughter can apply for her residencia on the back of her Mother’s as a dependant, but please note this would need to be done before she reaches 18 as she will no longer be classed as a child.

      You do not have to do anything, as only one parent’s signature is required for the residencia application. Your permission shouldn’t be needed. If your daughter is based in the Alicante or Murcia region, we would be delighted to help.
