Rapid Divorce in Spain

Did you know it is now possible, in some cases, to obtain a quick divorce in Spain?

We are now having many people approach us because they have read it is now possible in some cases to obtain a rapid divorce in cases whereby it is amicable and also that there are no mutual children.

For us to arrange this at a Notary the two parties have to be completely in agreement (and it needs to be in a deed). If this is not the case then it will be necessary for a lawyer to put in a proceeding to Court. Also, if there are children or other issues that complicate matters.

This new law is going to really help some of the burden on the Spanish Courts as many of them are overwhelmed and is a relief to clients who just want a quick and simple divorce.

So, who can do this?

One or both of the people divorcing must live in Spain and they must be helped to prepare an agreement by a practising lawyer as it has to follow certain requirements meeting the provisions of the civil code.

If the divorce is not amicable or there are children the divorce cannot be done in the Notary

What is required?

With regard to documents:-

1.- Title deeds

2.- SUMA/IBI

3.- Padron (both would be perfect, otherwise just one of them)

4.- Original marriage certificate apostilled if not Spanish

5.- Information about any assets of both of them and how they will be split

6.- Passports and NIE

7.- Power of attorney if required

There can be two proceedings, as in Spain divorce it is not like in Ireland or the UK and the actual process of getting divorced is dealt with separately to the financial arrangements usually.  This is because otherwise, it can take a long time to sort out a divorce when the two people are not in agreement and Judges feel that when there are children involved especially, it is better the divorce gets done, then the discussions about the economic side take place.

So for example, the divorce can happens first. And then afterwards we can quote for a change of ownership for any property in joint names or sole names to whoever is going to keep it.

      Dear Samir, There isn’t really an express divorce here. It depends on circumstances whether it can be done fairly quickly at a Notary or needs to be done through a Court. If you are local please email us more details. With kind regards

    We went our separate way about 10 years ago.
    We have no children from the marriage.
    We have no assets or property to share.
    We both want the divorce as one of us want to get married to someone else
    I understand there is the express divorce or notary divource
