Polaris Update

Following from our news last month about Polaris having been given three months to renegotiate their debts in order to regain liquidity, we have heard unofficially from Polaris staff that they have been given a reprieve by the Banks but this has not been formally announced yet.  Further news will follow.

Our Dublin Friends

A big thank you to all our Dublin friends that came to see us the first weekend of February at the office 117-126 Upper Sheriff Street, The Liffey Trust Centre.  We all loved Dublin! If any of you didn´t make it but have friends, family or colleagues who may be interested in Spanish properties (holiday homes, investment, bank repossessions) or assistance with legal or tax issues, please let us know or call Dublin 018188118.   For property transactions, there is likely to be a litte reward in it for you!!

DO YOU NEED A SPANISH WILL?

Everyone who has assets in Spain, in the form of property, bank accounts etc. should make a Will detailing exactly what they wish to happen in the event of death.

Whenever there is more than one person listed on the title deeds of a property, a Will should be made by each person.

A Spanish Will only applies to assets in Spain, and would have no legality in any other country.  If you have already made a Will in another country and have specified your property abroad, this may not be recognised as having any legality in Spain.  This is due to the difference in the laws governing the manner in which you can leave assets – Spain has a specific manner, which is that immediate family inherits in the first instance, whereas in the UK and Ireland you can elect whomever you wish.

In the case where a will has been made only in the country of birth, the process of having this recognised in Spain is lengthy and can be expensive as the documents need to be officially translated.  In addition, after the translations, it could be that the Will is not accepted in Spain.

If a person dies without making a Will, either in Spain or in their home country, a certificate would need to be obtained from the General Register Office in the home country (there is a separate office for England & Wales, one for Scotland, one for Northern Ireland and one for Ireland).

This certificate then needs to be officially translated.  Without a Will, the estate may be automatically disposed of under Spanish law and the law regarding compulsory heirs applied.

Making a Spanish Will is quick and easy to do.  We have a short form that you just complete, providing us with information to allow us to prepare a Will in Spanish and English.  Then when you are next in Spain we will accompany you to the Notary and translate for you, charging only 150 euros for everything or 280 euros for two Wills. If you would like any help, please contact Amanda on sales@spanishsolutions.net.

CAR ISSUES

If you are resident in Spain, you are required to change your paper driving licence to a Spanish one (this may still be used in Britain or Ireland) or you may be fined if stopped.  The Guardia Civil have told us fines are approx. 150 euros.  We can assist with the changeover of licences.

Driving  a vehicle on Irish or British plates is much more serious.  We were told recently they are now charging fines of up to 6,000 euros and the vehicle can be impounded.   You are granted a period of 6 months to legally import your vehicle.  We charge E550 for transferring onto Spanish plates and we can inform you regarding the additional taxes.

Don´t forget that we can also assist with transfer of ownerships of vehicles within a few days, provided we are given the appropriate paperwork (we will help you with this).  Please contact Amanda with any queries in this respect.
