Problems with Employers and Pay

From time to time, we have clients come to see us who have problems with their employers in Spain and being paid, either during their time of working or if they are “let go”.

Contract

Employers in Spain have an obligation to provide an employment contract signed by both parties and should provide the employee with a copy stamped by the local labour office.

Contracts are either indefinite ones, for full-time or part-time (basically a full contract), or they can be temporary ones. The temporary ones can only be renewed twice after the first one (so two renewals) or a maximum of 1 year, but in total, someone cannot be on a temporary contract more than a year.

You should make sure that you keep a copy of your contract.  If you do not have one, then be aware that you are working illegally and that the longer it goes on, the harder it would be to fight for your rights and what is due to you.

Pay should be by bank transfer and the employer must deduct monthly contributions to the Social Security from your salary, provided that this exceeds the minimum annual salary, which is around EUR 640 per month. These contributions are calculated as a percentage of your taxable income. The employer will send your contributions to the Social Security (Seguridad Social).

Your salary is also subject to personal income tax in Spain. The employer will deduct monthly amounts from your salary and forward the same to the Tax Office. The amount to be deducted will depend on your income level.

Payslips

You should receive a payslip each time you are paid showing the deductions made and keep these.  If you are paid by cash, then we would recommend that you retain the receipts you sign (which you should sign when you pay by cash).  You do need to keep some evidence of payment in the unlikely event of future problems.

Individual Dismissal

A dismissal must be notified in writing to an employee. Redundancy pay varies with the contracts.

If you are unhappy with this and do not agree with the decision, you may ask a solicitor to file a demand for mediation with the arbitration office – SMAC (Servicio de Mediación, Arbitraje y Conciliación) within 20 days upon receipt of the dismissal letter.

In this way, both sides may possibly reconcile, but it will involve a couple of visits to the office (the nearest one to La Zenia is in Elche) and a lot of paperwork and expense.

If this fails then you are entitled to bring a lawsuit before the Labour Courts, which are different from the general Courts, where civil and criminal cases are held. Again this is more expense, but if a Judge considers that the employer’s decision is justified and proved, the employment contract is terminated without any compensation.

If they consider that it is an unfair dismissal, your employer will have to pay and either compensate you or re-employ you.

Other matters

The usual working week in Spain is 40 hours, but this can vary with the profession.  Daily working hours are limited to 9 hours work per day, with a minimum of 12 hours’ rest between working days.

Overtime is restricted by law to 80 hours per year unless there is a special agreement for that particular profession. You must be compensated, either in cash or by paid time off in lieu.

Paid holiday is 30 calendar days unless again a special agreement for that particular work has been agreed.

Practicalities

What do you do if an employer is not providing you with a proper contract, or if you think they are not paying social security for you, or refuse to give you evidence that you have been paid?

In truth, there is very little you can do if you do not want to try to find alternative employment. The best advice is to sit down with the person responsible for this type of thing, justify and explain what an asset you are, and that you do not want to be working illegally. However, in the end, if will be your own decision what you should do.

If you have received a work contract, are you receiving payslips, then please keep them safe. If you wish us to help with a labour claim, then we need please a copy of the contract, payslips or copy cash receipts and any emails between you and the company regarding the situation, or copy Whatsapps, as well as a copy of any dismissal letter. Please do not forget there are only 20 days to submit an appeal to an unfair dismissal.

If you go to the police, they will not take you seriously with a labour problem, as the proper way to handle it is as above, but of course, it is always best avoided at the start.

      You need a local asesor to check the redundancy payment (finiquito). You only have 20 working days to appeal for redundancy and a year for salary, so please contact a local accountant or asesor. We believe it is normal to be paid in the usual end of month payments. We hope this helps.

    I live in Lorca, a city where illegal migrants are being exploited by farm managers. The bitter truth is that, most of these migrants do not have permit to work and as a result are been forced to work without documents or sometimes with someone document.
    Most of them end up been cheated or sometimes a little reward or salary than they deserved. My question is, is right for a firm to exploit them, knowing from the get go that they don’t have document to work.
    I understand these migrants are not supposed to work but to preserve their life they still have to get something doing, and for that,how long will the law protect these greedy firms who exploit the poor migrants?

    I left my employment on July 23rd due to poor working conditions and illegal overtime hours. I have yet to receive my pay from the days worked July 1st – July 23 and it is now August 9th. I do have a contract, but nothing that says when I should be paid. I understand it’s usually on the first day of the next month for the month before. So August 1st I should have received my pay from July. Please let me know what I can do. I’ve asked my previous employer why they haven’t paid me yet and they will not answer me.

    My step-daughter who is 17-years old has worked for a month at a local bar the owner has worked her from 11.30am until 3am the following morning on at least 20 or more days.

    My daughter obtained an NIE after 5 days of employment at the employers request a contract has not been presented until only yesterday and it states that she has to work 7-days.

    My daughter’s employment was terminated yesterday without a signed contract that was illegal and flawed throughout. Worst still the employer in Cartajima is refusing to pay her a single euro.

    What should I do?

    Hi,

    I have been working for a norwegian company in Spain for the last years. I have been working as an autonomo since the beginning but even though I have been autonomo I have been treated like a employee on contract, in every setting that has benefit to the owner of this company. I believe this is what they call false autonomo. The employer has been hiring as autonomos to skip many costs, tax and responsebility etc. I recently resigned from my job, and asked for a letter of recommendation, like a certificate that describes what I have done in the company and for how long. The owner of this company refuses to give it to me, and the last mail he sent me was “I can not give this to you, as you have never been an employee”, something that I can prove that I have been via email and payments etc. Are there any legal rights that says that he has to give me the proof of my work in Spain? In Norway there is a law saying that it is your legal right to get this kind of certificate when you either resign or get dismissed.

      There is no obligation in Spain to deliver a letter of recommendation.

      You could sue the employer and claim social security contributions for having had you as a false self-employee, but we would not know if we could help until we study the time situation and where the company is based.     Hi,
    I’ve been working as a teacher in a school for the past 4 years and having some issues with my bosses. I have an indefinite contract for the last 2 years. My bosses are now requesting extra documents (degree from university, police checks etc.) which were never previously required. As a result of my degree being in my native country and not being able to obtain it on short notice they have changed my role in the school and I am no longer happy to work there.
    My problem is that I have misplaced my contract! Is there any way that I can request a new copy of the contract, either through my work or through the Public State Employment Service.
    Any other advice on my situation would be much appreciated!

    I had a job with the promise of a contract , I signed papers for said contract supplying passport , NIE and social security numbers , I have been bullied and had to work in 40degree heat in a kitchen with no ventilation hence I walked out , I never got my contract and I know people still work there who don’t have a contract , is there anything I can do to rectify this matter .     Hi.
    I have been working for a company in Andalucia for almost three years, I am on an indefinite contract. In my contract I have a clause to be spending 70% of the time abroad searching for new clients.
    I am overseas now in Australia where I passed the August vacations, however I am always working on the phone etc with our clients. I have family issues (children) in Australia and cannot return to Spain where my employer wants me to be based as usual.
    I have not been paid for August- though it is normal for this company to be very late with pays. I’m also awaiting a bonus for completion of a project.
    I have a feeling I may get sacked in the next few weeks as time becomes longer away from Spain. My job involves a lot of travel especially to the USA. I have explained that I am having family and also financial issues but really don’t know what to do.

    Hi. My boyfriend works for a construction company here in La Palma, Canary Island. They haven’t payed him for the month of November working. He works 5 days a week, 4 of them he works from 7.30-18.30 with a 1 hour break. It’s 10 hours working 4 days a week, the 5. Day is only 5 hours. Anyway they are told only to write 8 hours on the papers and not 10. Despite of that the company is late with their payment? Is that legal? I mean normally he is payed around the 10th and now we’ve got the 27th. He has rent to pay, and children to buy presents but without money is difficult. The same thing happens to his coworkers but no one speaks up. Also the salary is not registered correctly. He normally receive around 1300 a month but registred on papers is only about 900. Now he has been sick and away from work 4 days in November the company has decided to take 160 euro of him pr. Day hi wasn’t there = 640 euro for 4 days missing. Explaining they can do it thanks to the law (as nearly the only time they stick to the law, when it is in their favor). 1300 – 640= 660. In all this time waiting for his money, the day before Christmas the boss gave them 150 euro of theirs. He should therefor have 510 payed for the month of November working 45 hours a week(without counting breaks) – the company at the end payed him 425 euro and we have no idea why it ends up like this. But is there not something we can do? Is it legal that they can just hold on to his money for this long? Can they really take 160 euro of him pr day of being sick (he was that stupid not going to the doctor for a paper, but never thought it would cost him 160 pr day)
    For me it is completely crazy they can get away with it. He works 45 hours a week on paper only gets around 900 and for 4 days being sick they take off 640 euro = on paper for the whole month working minus 4 days = 260 euro.
    Now he has decided to stop with the company. And now waiting for the finiquito that they haven’t giving him yet plus waiting for the money of December. How long can/should we wait? Do we have any rights? Is there anything to do to stop this company? In my Danish eyes this is big time social dumping! The other guys at the place don’t dare open their mouth, they are old and maybe have harder getting another job, so they accept the late payment, working the extra 2 hours “free” pr day and accept how he claims his rights and stick to the law when it comes to take money of them if missing, but how he otherwise avoid the law and do the things dirty. An advice would be very helpful :)

      I´m guessing it is not like this in Denmark!
      Seriously, the company is totally in the wrong. They are breaking the law and there are a number of options available to your boyfriend.
      Does he have proof of the extra hours worked? This is important and if he has it, I think he should contact his employer and explain the situation. If he is leaving anyway, he has nothing to lose.
      He can ask them in a kind way to compensate them and if they refuse, he can tell them of his intentions to take a legal case.

      I’m sorry to hear about this, normally employers in Spain are fair and decent.

      It sounds like your employer is 100% in the wrong here.
      Do you have anything in writing?
      Try to negotiate in a friendly manner. You can mention the fact that we have spoken and see if that helps them to see any sense.

      Ten days sounds excessive. Have you talked to your employer?
      Often it can be a bank issue. Maybe you need to open an account from the bank where wages are paid for convenience. I think if you explain to your boss the importance of being paid within a few days, they will respond well.

    My son left his job in Spain amicably, to return to Uk. He has been waiting for his last wage from the employer. He has emailed 2 times over two weeks with no response!
    He has now had an email from the employers solicitor saying the office keys have not been given back- accusing my son of having these and threatening with taking this further!
    My son has handed the office keys back to the owner who is refusing his pay! Coincidence!!
    What can my son do in this situation please?

How can I report this or sort it out? The owner is a heroin addict It’s all cash and nothing is legally registered I don’t think, they’re a scam.     I currently work in the Canary Islands in a bar on an indefinite contract, but the owners are selling it, so I’m unsure where I stand!! Do I get redundancy money or do the new owners have to honour my contract an keep me employed?

    Hi, In summer 2017 I was persuaded with my colleagues to move from a temporary contract to an autonomo contract. For some of my colleagues it was just days before they would have had to be presented with an indefinite contract. We were told there would be no loss of benefits and that may be largely true except some of my colleagues have been forced out for not meeting ever aggressively changing targets. I feel very stressed and wish to know if I will be entitled to any redundancy if forced out. Also can I force redundancy on the company on the basis of stress and latent threat of dismissal?

    Hello I was wondering if you can help me I quit my job 2 days before the pandemic under avise from one of mangers telling me to leave the country and seek employment back in England and to come back to work in Madrid when the pandemic was over I was forced to sign a piece of paper I was not as to sure what I was signing at the time and I said to the other Manager that I was coming back ASAP and when the end of the month came my wages where not paid and they say because I could not work my notice I’m not entitled to the money I worked for and European Union law says that they have to pay me what I’m owed I’ve recently come back to Madrid and ask for my job back knowing that they are looking for staff but all of sudden they don’t want me back

      Dear Maddy, I am not sure whereabouts you are but you only have a short period of time (a few weeks) to file a legal case for redundancy salary is one year. But we do not do legal aid cases. We have not yet been given contracts and after working a total of 285.5 hours in total, yesterday the owner phoned me to say he is letting me go with immediate effect ‘because he cannot afford to keep me’…what am I to do?     I am currently on ERTE due to coronavirus. I need proof of wages for a tourist visa but haven’t received them from my employer since the pandemic began. Should I be able to still get a payslip from my employer or somehow from the ERTE scheme?

      Dear Donna, You are on a temporary suspension scheme so not being paid by your employer, the payment will come from the government. I can only suggest that you supply the documentation showing you are on ERTE together with your previous pay slips.     I’ve been on ERTE for the last 6 months and I decided to leave the company. My contract says that I need to give 3 months notice but I am leaving with 6 weeks as I cannot wait any longer plus someone told me that companies cannot ask for 3 months. Now the company is asking me to pay them for those days so I have to pay them 3-month-salary… I am leaving basically because they did not pay my full salary and can they ask for that? I rechecked my contract but I don’t see any clause related to this.

    Hi, I have an employee who is not happy with her new contract even though when a reduction of hours was discussed & the contract signed this was not an issue. She started in high season on a 40hr contract but now in low season she has 28hr contract. The issue is that at times due to us being busier than normal she worked over the 40hrs. Now we are in low season I don’t need her so much so by the end of her contract all will balance out. Any extra hours have been paid for and by the end of her temporary contract all with be correct regarding number of days worked with social security.
    She is basically unhappy because before her job with me she hasn’t accrued enough with social security to claim parro or ayuda and was expecting a longer contract with me but now my business has dropped 80% due to COVID restrictions and summer season being over.
    My concern is that she worked over her 40hrs some weeks of the summer, But it was very difficult to judge how this season would go.
    All nóminas, contracts and contract renewals are signed.

    My employer didn’t renew my contract. I didn’t receive a letter or verbal explanation I just received a finiquito in my online bank, followed by my usual monthly pay. They are insisting I return the signed finiquito asap. How long do I have to return it? Should I have received a letter to tell my I no longer had a job? Thanks

      You can sign the finiquito. If it was a temporary contract finishing, unfortunately nothing can be done. It would have been good practice for your employer to have advised you in advance.

    Hi, at beginning of Dec 2020 I left mypart-time cheffing job under duress because my boss employed an ‘experienced’ manager who, although she claimed 30 years experience, clearly had none, and not just myself was it obvious to. I walked into work on that last day to hear the new manager shouting at a colleague, in front of a customer. Same person followed me into the kitchen and started on me, without reason. I walked out and contacted my boss immediately but it took my boss until the following morning to contact me, obviously having heard one side of the incident only and having taken sides by that time.
    11 days later my boss asked to see me. We met and I asked her only for my annual leavepay over due (none received at all) for the 13 months I’d worked for her. Initially she refused but then offered 150 euros!
    The list of faults in her business and pertaining to me( and others) is endless: contract took a year to get from her; it said 10 hours per week yet I worked 22 per week; no holiday pay; as an adult was paid only 6 euros per hour; no payslips; she introduced the new manager at our staff meeting having never advertised the job nor recruited for it; when on ERTE for 4 months I was paid 70% of a reduced sum (appeared to be 70% of 70% so I got just over 200 euros per month yet earned 500 euros per month!) etc etc …
    My boss eventually told me to correspond with her gestoria which I have and the information arrived only a couple of days ago and yet again, only pertains to 6 months of my 13 months employment, ending in October 2020?!! All I have asked for is some annual leave pay, 500 euros and have told my boss I’ll walk away without further ado if she pays me it – she is flatly refusing even though I’ve explained the consequences (denunica etc). She even went on facebook with a sob story about people using her and letting her down…! I was gobsmacked.
    What is my next step? I am considering going to CCOO or UGT unions for further advice.

    I have been working for the same company since 2017 in Barcelona. After a year I was promoted as one of the team managers. As our company runs 24/7 we require to work night shifts aswel.
    They insisted I sign 1 A4 page which was in French and had no idea exactly as to what was on it. Thereafter I got a slight raise on my basic salary, however stopped paying me for night shift differential and transport. Almost 3 years later when other managers also kept insisting they owe us night hours pay, they started paying us night differential again, we never signed any documents or anything, they just started paying the night hours too. Even tho they have now re added the night hours, the “complemento bruto absorbible” reduces by about the same amount, so practically still earning the same. Are they entitled to pay me for the night hours I did during those 3 years they were not paying us for it?

      Dear Abigail, I think it would depend very much what type of things you were asked to do (for example if blatantly illegal then a NDA would not apply). If you are local and they are matters of a legal nature then please send us an email. If they are to do with laboral issues or tax then you would be best to refer to an Asesor for advice.       Dear Tom, Generally unpaid holidays days are only applicable for the calendar year so would have expired for 2020, and be pro-rata for 2021, unless there is a separate personal agreement with your employer. Kind regards

Now I got work from greece so i quit my contract for that company so they don’t have to pay anything for my ERTE anymore. and I have already moved to greece, however the company refuses to pay me my vacation money or anything.     Hello I am a teacher and have given my resignation letter in to leave my job at the end of the academic year. HR have said I need to come into school on my last day (31 August) to sign the finiquito. However I have booked a flight to return to the U.K. at the end of July. My question is whether I am able to sign the finiquito in advance or digitally so I don’t have to come back to Spain to sign and receive my last paycheque? Thanks

    Hello,

    I came here on a student visa in 2019 to do a master’s programme and work part-time for the university without pay as it was a part of my scholarship. After my studies, I was “employed” by the school but to avoid giving me a work contract and paying taxes, they gave me an admission letter saying I was studying for another year, however, not implying this time that I was an internship to fulfil. So, for the past year, I was technically working as a student for 40 hours. Requesting more money as I’ve been working for a year, they say they can’t pay more than 1,500 euros to a student as it will look sketchy (though what they are doing is already sketchy). Is this true? Is there a max amount you can receive working on a student visa?

    I had an indefinido contract and have been working for the company for 3 years. The other day they sacked me for an unjustified disciplinary reason (I never did any thing wrong at all and they didn’t give me a specific incident) and told me I had to sign a document for my last pay, which stupidly I signed since I was in shock. I assumed they would send me notice when they calculated the final payment they owed me (33 days per year) but they have just stopped contact with me. It appears what I signed was not my final pay but in fact my total finiquito! Is there anything I can do now?

      Dear Alan, I am really sorry but if you signed it, unless you put “no conforme”, I don’t agree with it, on the document there is nothing you can do. They do not a reason to let you go here but they do need to pay you the finiquito. I am sorry we cannot help. Kind regards

    My employer has asked me to sign a 10 hour per week contract – 2 hours per day Wednesday to Sunday. I normally work a rotating shift that varies 2pm – 7pm or 5pm to close. I have recently been working 12-14 hour shift due to staff shortages (I agreed and offered the extra help). I have been asked to sign time sheet for the accountant, 6pm – 8pm (thats what the contract says). On the time sheet there is a place to declare hours above contract i.e. extra worked hours. When I started I advised that I need a minimum of 25hrs per week. I have asked if the extra hours will be declared and she has told me no and that if they are then I will have to pay the extra charges that she will face and not her. My concern is that I am not paying the correct taxes and social security money, especially in these uncertain times. What is correct? Surely she should be declaring all the hours that I am working at no extra charge to me. I am only earning 8€ an hour. My understanding is that whatever the hours I work I should always take home 8€ per hour and all hours should be declared any additional cost is borne by the employer not the employee am I correct?

    I am Subeesh Therkayil Sukumaran ,an engineer by profession from India.I got an opportunity to work with Spanish consultant company in Valls Tarragona.
    I have joined the company on November 1st week 2022 worked from India till March 1st week of 2022 and came to Spain with family (comprised of wife and two kids ) on March 8th and signed a contract with Company.
    They have offered me a salary which they gave me a confidence that it would be more than enough for a family of four. They had also promised me verbally that they will give assistance for finding a job for my wife as well as she is also an engineer by profession . As the days went by we were struggling to meet our daily expenses with the current salary and they did not give any assistance for my wife to find a job .
    In between my wife started searching for her by herself and she found a job ,but they said that she needs to relocate to Barcelona for her job ,since i had the hardware dependency for my job and i can not do my job remotely if we relocate to Barcelona from valls .However i somehow managed to work with Company ,but again i came across with an another problem ,where company did not pay my salary on 1 st of every month. Due to this i got really frustrated and put my resignation on 5th of September ,when i put my resignation ,company held my salary of August by saying a weird reason that they can not give the salary since i put my resignation .
    In fact they did not mention this in my contract the only thing they have mentioned in the contract is i need to serve 15 days of notice period after filling my resignation. On my last day in the company ,they came up with a letter which says that they paid lot of money for our visa process and flight ticket due to this they won’t be able to pay me the last two month salary and they insisted me to sign in that paper which i did not do. Also they were saying that as per Spanish law employer have the right to deduct the amount they spend on Visa etc. if the employee leaves the company with in one year as it was not mentioned in the contract .I would like to know whether i am able to do anything legally against the company in this case.

      Dear Subeesh, I am sorry to hear your story. We are in a different region of Spain and in Spain laboral issues must be dealt with (as quickly as possible) in the area where the company or head office is based. You need to contact a lawyer in Valls or Tarragona city. With kind regards.

I’ve been working full-time for a foreign company via Workmotion for 7 months. Unfortunately, the whole company is being laid off so our indefinite contracts are being broken. I was wondering if I would have any rights to any severance pay, even though I was working for the company for only 7 months?       You have only 20 working days to claim redundancy from when you are fired; you may have although probably not a great amount. If within that, you should contact the Social Security office in your area of Spain as soon as possible. With kind regards

    My employer pays me in cash but I need my nomina paid into my bank account to avoid bank charges. He is refusing to do this, is this legal?

      Dear Marie, If the amount of the nomina is more than 1000 euros the employer needs to pay you by bank transfer, by law.

      If is less than that amount, the employer need to give you the document and the nomina and the employee needs to sign that he has received the money in cash. Kind regards
