No Win No Fee – As Easy as 1,2,3

Not so many years ago, No Win No Fee cases were almost unheard of in Spain, now that is no longer the case.

Some law firms, including us, will consider legal cases and put up the upfront costs on some occasions. These cases have to be serious cases, involving a serious negligence or loss. It is very unlikely that a firm in Spain would consider covering legal costs themselves for issues such as community, employment, tenant evictions or other matters that do not involve a significant injury or loss.

However, in some instances, it really is as easy as 1,2, 3, to have your case considered and a legal action prepared, against say a bank.

What are the steps?

1. Explain the story. It may be that you were on a bicycle, hit by a car and severely injured. Write to us, tell us exactly what happened, where and when.

2. Provide the evidence. If say, it is a case whereby you lost a deposit paid on an off-plan deposit and we can possibly sue a Bank under the Supreme Court Judgement relating to this, then we will need copies of documents such as

  • – purchase contract
  •  confirmations of amounts paid by credit card or bank transfers
  • receipts of payments received by the property developers-
  • the initial total price of the property
  • the correspondence (if applicable) between you and the property developers (and any other written communications that may be of use for the case) –
  • any copies of any Court documents
  • any other documentation you can think of.

If it was an accident then we may need photos, police report, medical reports, other side’s insurance details.

3. We work together as a team. That means that if we ask for additional information it is because we need it for the case and we need you to help us, to help you.

If it is a Court Action, then you will need to come to Spain at least once in the years to come.

However, it really can be as simple as 1,2, 3. A gentleman contacted us two weeks ago saying they lost 36,000€ nine years ago on a deposit put on a property and could we help on a no win no fee basis? At first they thought they had thrown the paperwork away but when we said please look for these particular documents, they found everything, and they have a good case, which we are prepared to fund in advance for a percentage of the win.

We should advise that we are not able to take on all cases on a No Win No fee basis but we will give our opinion and advice in most cases for free. Sometimes further documentation is required to evaluate a case (such as an expert medical report).

    Hi, my dad died of heart disease almost 3 years ago in Spain.
    He had a life insurance policy with a major Spanish insurance company. He told me it was for about 25000 euros. I have been in touch with their representative in Alicante, who my dad took out the insurance policy with. After several emails and phone calls they kept asking for more things like medical history etc.
    I have sent everything they asked for, although sometimes it has been difficult to translate exactly what they wanted.
    The last time I emailed them was August 2018, I told them if they didn’t pay soon I would look for a no win no fee solicitor.
    They ignored this email completely. Would you be interested in taking this case on a no win no fee basis? If you need me to forward all emails and copies of the things I have sent to help you reach a decision, please let me know.

      Thank you for approaching Spanish Solutions. I am sorry about your father.

      I am sorry to say that, in our experience, this is quite common with life insurance in Spain. We would like to try and help you, so if you could please send me scanned and emailed (in as few as emails as possible please), the following:

      – a copy of your dad’s death certificate
      – copy of any Spanish probate done (I suspect one has not been done), if not a UK one
      – a copy of the insurance policy
      – any document showing the balance or amount of the policy if you have it
      – a copy of relevant emails/letters with the insurer
      – a copy of her medical records if you do have this ?

      Then we will study the case and see if and how we can help you, and if on a No Win No Fee Basis. You will incur no fees for this, if Pedro feels it is a good fit.

    I bought a small boat 4000€ at Fuerteventura and the mast was broken when the first sail. The property ownership was still named by priviouse owner and I could not buy the insurance. He told me that he has the insurance however it was only for the third party accident.
    He convinced me to fix all. Never he had done it. I asked pay back and asked the Colegio de abogados.

    Therefore, I could get a lawyer at colegio de abogados at Las Palmas. I did all my paperworks and claims has accepted there and it has go through the regal claim at Las Palmas.

    But the Spanish lawyer never talk to me and then finally, she has cut me off for no reason.

    I need some help.

      Hi, I am sorry to hear your problem but for this type of case in the islands, you need a lawyer there, as we are on the mainland. But you have obtained a legal aid lawyer through the Colegio de Abogados, you need to go back to them and complain about your lawyer if she will not talk to you. Good luck!
