We are receiving many enquiries about if there is an obligation or not to exchange Residencia to TIE

Obligation to change the Green Residence for the TIE

If you applied for residency before the 1st July 2020 you will have a green residency card or A4 Green residency document.

If you have green residency, you are not legally obliged to obtain the new plastic TIE card.

Recommendations

In conclusion, the Spanish government invites you to apply for the TIE, although it is not mandatory. The new card is a plastic TIE CARD with your photo and fingerprint and is far superior to the paper green card. You can use the TIE as the ID in Spain.

We have also had reports recently that airlines etc are looking for this as proof of residency, although they should accept this in the previous form too.

    I can demonstrate Spanish residency (via bank statement transactions) pre 31st Dec 2020.
    Since 2021 (January!) can also demonstrate both adequate private healthcare cover & financial income; can i still legally apply for Spanish residency [TIE card] up until March 2021 {as a British citizen} ? [Padrón registration was not done until January 2021 but i’ve been told it’s not a legal requirement to of registered pre 31st Dec under EU Law to prove residency]
    Do i have a legitimate legal case for residency [TIE card] application please?..

    Hi there,

    I was wondering something about the TIE:

    I got my TIE under the Withdrawal Agreement. It is valid for 5 years. Does this mean I can leave Spain for 2-3 years and come back and then apply for a new one?

    I understand that to apply for continuous residency, I need to remain in Spain for 6 months of any 12 month period, and after 5 years I can make an application.

    However, that’s not important to me right now. The freedom to come and go (as I often take contracts 6+ months for work) is far more important. Possibly after 3-4 years, I would return with the intention of remaining in Spain.

    Any advice would be immensely appreciated.

    Hello, is it possible to apply online for the exchange of the A4 green paper for the plastic card. I had a plastic card years ago and it was repalced with the green paper version 10 years ago, so they already have my finger print. I know in France this can be done .

      The process to change the residencia to TIE must be done here in Spain as you require to attend and give a fingerprint both at application and collection. Please contact us if you wish us to assist with your swop when you are in Spain.

    I have a 10 year green card-sized NIE with “caracter permanente” on it, due to expire in 2023. I spent more than two years out of Spain. Can I return and exchange for a TIE, or is it now invalid? If so, can you help me to exchange it if I move to Alicante? How much would it cost?

      If it is an NIE then that is not a residency card. If it is a residency card you first need to check it has not been revoked.

    I have lived in Spain for 18 year, Im on the pardon in my town hall, I have the green plastic card which is out of date, but it has photo plus fingerprint but was then given the green A 4 paper, I have proof of paying my taxes, my husband is Spanish so can accompany me to police station,,, only thing is not very computer-literate so not able to make appointment and pay the fee beforehand help please and your cost,

      To obtain a 10 year residencia/TIE card, you firstly have to have your residencia/TIE for 5 years, When you renew your residencia/TIE card after 5 years, you will be given a TIE card valid for 10 years.     I am courioUs I am from Iceland and i have a Green A4 paper Residencia i got it 10 years ago is it possible that my Residencia has been Revoked i have been told that i dont have a residencia fiscal but it does not say anywhere on my residencia that it has a expiry date i have lived here couple of times and then back to iceland and all ower since ICELAND IS IN ESB AND i moved here when i got it from the town hall in playa flamenca 10 years ago is it not 100% valid at least just not residencia fiscal i get that when i start to work again here i moved here back 1 year ago been living on savings and another propably stupid quistion this TIE card i know what it is but it is much more useful becouse its an id and my Residencia is just a paper and i now i can get this rubish smaller green residencia card but can i get TIE ore is that just for people outside of EES/ESB

      Fiscal residencia is when you are resident and pay your taxes in Spain. Please note, if you are in Spain for more than 183 days of the year, you are liable to pay taxes in Spain. As you have been out of Spain for some time, we would advise visiting your local Foreign Office to confirm if your residencia remains valid.

      In regard to the TIE card, this is only for Brits, we are unsure if this would change in the future. We hope this helps.

    I have the green A4 Green Certicado de Reistro de cuidadano de la union. It’s says residente permanente. I grew up in the Canary Islands age 11 to 23 .
    Uk passport holder. Not lived in Spain for 8 years.
    Wanting to move to back to Spain.
    I have read many different websites . Very confused. I have read that the green a4 doc is still valid.

      Thank you for your enquiry.

      You need to check if your residencia is still valid, this would have to be done at the Foreign Office on the Canaries. If you can not travel to Spain, you may find a Gestoria /Solicitor on the island who can check if the residencia is valid for you.

      The green residencia document is valid, but at some point it may be compulsory to change to a TIE card. We hope this helps.

    Hello,
    I have already lived here for 3 years and have the green residency card to prove it. If I change it to a TIE card will I lose those three years because there is no where on the new TIE cards that states the original residency date?

      Afternoon Paul,

      Thank you for enquiry.

      You will not lose the 3 years residencia. When you apply for the TIE it will state “temporary” until your residencia reaches 5 years, after this date it can be changed and would state “permananete”. The Foreign Office will have your initial residencia application date registered on their system. We hope this helps.

    Having recently reached 5 years of residency, I made an appointment at the Comisaria in Malaga to update my temporary TIE (obtained in Nov 2020) to a permanent one. That appointment was today. I was told quite categorically that this was not possible, contrary to what you have advised above in response to Paul West. I have no doubt that your opinion is correct and would be grateful if you could point me in the direction of any authoritative statement/guidance from the spanish government about this. Many thanks.

      Thank you for your enquiry.

      You need to have been in posession of your residencia/TIE card for 5 full years to obtain a premanent TIE card, it would not be the date which you entered Spain or registered on the padron, it would be 5 years from the date on your residencia.

    Good afternoon,
    I have a green A4 Certificado de Registro de Cuidadano de la Union from 2004, am registered on the padron since 2003, have worked and paid taxes here over the years and bought a flat etc. Im considering changing the green form for a T.I.E. under the Brexit agreement. However my Father is Spanish and I see another option to apply as a family member. As I need to go back and forth, does either option offer more freedom of movement in regards to timeframes between Spain and the UK or is the end result the same?
    Also, do I have to go back to the UK after 90 days in 180 or am I fine with the green paper? Even my local police are confused as to the legality of the green paper now!

      Thank you for your enquiry.

      The green residencia certificate and the TIE card are the same, both will give you freedom of movement between the UK and Spain.

      When you change the residencia to the TIE you are not applying for the residencia again you are converting the paper residencia to the TIE card, everything remains the same in regards to your residencia.
