Q. We had this enquiry today, which may interest some people.

Just a quick question that I think you will know the answer to. If someone buys a property that already has a tourist rental licence is the licence transferable or would the new owner need to apply from scratch?

A. This was our answer.

Thank you for contacting us.  When the property has the tourist licence the new owner can change it into their name.  The buyer has to sign an application form, with a copy of the licence and their identification, and send it by Post to the Tourist office.  We can help them with this process for 40 + VAT = 48.40€ fee.

      Hello Pat,
      Have you already bought a rental property in Benidorm? I ask because if not, we can take a look where you are thinking of buying and give you an accurate assessment of the specific rules for that area.
      Benidorm is not the easiest place to rent short term- the hotel industry is very strong there and they don’t want it.
      Property rental around the Orihuela Costa is red-hot right now, if you are buying for investment, maybe it’s the place to be?

    Hi I applied for my licence in June 2018 through my Solicitor and she had to apply again in February 2019 as they told her the goal posts had changed. It is now nearly July 2019 and I have been told that they are over subscribed and are not issuing any certificate of compatability from the town hall and that without this we can’t get the licence. This is for renting our property in Orihuela Costa. Any help would be greatly appreciated.

    Hi . We also have trouble to receive cer­ti­fic­ate of com­pat­ab­il­ity from the town hall in Orihuela Costa. Applied in november 2018. Is there any alternative to cer­ti­fic­ate of com­pat­ab­il­ity from the town hall ? Would it help with architect visit to the property? Thanks

    Hello. We own a casita in Jalon valley area, the deeds are classed as rural/rustic land. The casita sits on a plot of 2.200m2 land, we are very much hoping to put 1 or 2 glamping pods (temporary structure building that can be moved )­ on our land to rent out, would you be able to give me any information regarding the spe­cific rules for this area, and what the likeliness is that we would be granted a tourist licence on rustic land – ultimately I understand the decision is down to the town hall but any information to help us would be appreciated.

      Good Afternoon Stacey,

      Generally, if you have a habitation certificate, you should get the tourist licence but there are exceptions. We would recommend contacting the town hall with your Catastral Reference and ask if a tourist licence is possible.

      Please note if you are planning to have guests on your land and they are not renting the full property, you would not need a tourist licence, you would need to open a company as you would be seen as a hostel.

      We would recommend speaking with a local Fiscal Advisor (accountant) who will be able to discuss this fully with you, we hope this helps.

    Hello we are looking to buy a property near Traiguera, Castellon. it is all one building with separate studios. So we would be living in the building but wanting to rent area to tourists on short term holiday let. What licence do we need to get for this, and how likely is it in this area please. The property is rural and on land over 10,000m2.

      For this you would need an opening licence and also to start a company. We would recommend having a consultation with a Fiscal Advior who would be assist you in opening the company and obtaining the relevant certificates.     Hi, I’m planning on buying a little studio apartment in Torrevieja which I’d like to let short term. Would you be able to help me with getting all the tourist certificates needed and how much would it all cost? Also I already have an apartment in torrevieja which I’m renting long term(bought it last April) and will need help with property tax this year

    We are in the process of buying an apartment (ground floor) with a tourist licence in Valencia, is it a certainty that the existing tourist licence can be transferred to my name when I bought the property? More than happy to pay the 48 euro fee if I now for a fact that this transfer will happen. In case it is not certain, I probably will not buy this property, so this information is very valuable to me.

      Thank you for your enquiry Roland,

      The tourist licence is for the property, not the owner. Providing the correct and required documentation is submitted, there should be no reason why the name change can not be carried as the tourist licence do not expire and is already in place. We would only deal with the name change as part of the conveyancing process, not as a separate service, we are sorry.

    My name is Adrian,

    Maybe you can let me know if a turistic apartment currently with a license what it it not at the ground floor(it’s at the 4th floor) can have the actual license transfered to my name in case of purchasing it
    and still be used as a turistic apartment or it is not qualified because it is not at the ground floor or other things.
    Also if you do the license transfer and what is the cost and time.

      Morning Adrian,

      If the property has a tourist licence the name can be transferred to your name after the purchase, no problem. If a property has secured a tourist licence, it will not be revoked.
