How To Revert to Your Maiden Name in Spain

One of our clients, Robyn, recently asked how do I revert to using my maiden name in Spain, after my husband died? The same could apply had she have divorced.

We all know how awkward paperwork in Spain can be and when you think of all the places that a name is included, such as on the padron at the town hall, on your deeds at the Land Registry, on your NIE number, on your utility contracts, on your driving licence… the list goes on.

So what did we tell Robyn? Firstly, the process starts in her country of origin; in this case, in the UK. That is where the official paperwork was established with her current names, so that is where it needs changing. Then after that, it will need to be changed in Spain using that evidence.

Robyn does not actually have to go back to the UK to do this.  She uses her married name “Matthews” thus what she needs to do is to officially change that name and the way to do it is by deed poll. To be honest, if she had stayed in the UK, the death certificate and marriage certificate would probably be enough to show that she was changing her name back to her maiden name, but when it involves Banks and definitely for overseas use, it needs a deed poll as it is recognised as legally valid. The same goes for divorce in that it needs to be formalised for overseas use.

So Robyn applies to change her name back to her maiden name by deed poll.  This applies only to the UK; it is different in Scotland and Ireland.  Once she has the certificates from this, she needs to apply for a new passport in her new name. She must keep a good copy of her old passport though as it will be needed for the Spanish notary.

Then it is important to get the deed poll certificate legalised for use in Spain with a Hague Apostille. This too can be done online,  Once done, it needs to be sent to Spain and to be translated into Spanish. (We can help with this .  Then an appointment will need arranging at the Notary to arrange a deed of acknowledgement or “Acta”  and sign this; whereby an official document prepared in Spain to verify the name change. She will also need to be present, but she is living in Spain anyway. To do this, Robyn will need a good copy of her old passport, her original new passport in her maiden name, and the original of the deed poll certificate with the Hague Apostille affixed.

Costs can vary and we can arrange a quote for this service.  Once you have this Spanish deed and I would recommend you get a few copies you can send it to all the places your name needs changing (Bank, utility companies, tax office etc.) The Land Registry would charge a few to make changes and you may wish to leave this for a while.

    Great article! However, one thing you don’t explain is how to get your new uk passport in the new name. For name changes, the passport office require proof of new name usage, which can be one of the following; a letter from your employer, a letter government department, a bank statement, a voters card or drivers license, with your new name on it. To change your name on any of these in Spain, you need your new passport! How did you get around this?

      Sorry Jamie, Robyn’s situation was different and a while ago. I think you might need to have a conversation with the passport office about how to get round your problem as documents required change over time and depending on circumstances. But generally I think it will be to do with how you changed your name (marriage, deed poll etc). Good luck!

      You would need to have old passport as well as new one , if you are a UK national would be applying for a TIE card with old passport, new passport and proof of name change in spanish ( legally translated if uk ) bank statements would also be required.

    My partner and I are getting married in a few months. He has dual citizenship in both Spain and Scotland (I am from the US). We are getting married in Gibraltar under UK law but plan on residing in Madrid. I plan to take his last name, but we were wondering if I will be able to use my new last name when applying for my NIE in Spain or if they will require me to use my maiden name. To further complicate matters, I was married once before and still use my ex husbands name as my legal name, including on my current US passport. Will this present a problem? Or will the UK marriage cert with my new married name be sufficient to also go by that name in Spain?

      Thank you for your enquiry.

      The name for your NIE will depend on your passport, as this will be the document that the Foreign Office will use as your identification. If you marry and change your name at a later date, you can change the detail on your NIE as long as your passport has been changed to your new name also. We hope this helps.

      You would have to go back to Trafico and advise them of the error, you will need your passport and residencia/TIE as evidence of your correct name. You should not have to wait as long this time. If you need any assistance with this please come back to us.

    Hi,
    I am a Spanish national living in UK. I would like to change my name so I can have my two surnames hyphened, if possible, before applying for UK nationality. All I have seen on registered deed poll applies only for British nationals but on the other hand, there is an exception for dual nationalities when the one (Spanish) doesn’t allowed the name change (make one surname of the two surnames). Do you know what steps should I follow and what documents I may need to prove the exception?

    If the deed poll is signed in Spain how do you manage to get it legalised in the UK as it has to be signed physically in the UK in front of a notary or a solicitor? If in Spain is it sufficient to sign in front of a Spanish notary to avoid needing to have it legalised?

    Hi, I’m a U.S. citizen living in Spain. My passport and TIE have my married name on them. I’d like to go back to my maiden name since we’ve divorced (here in Spain). In the US, we have to surrender our old passport when applying for a new one (first step to changing name on TIE). So what do I do if the Spanish government wants to see the old passport? I can’t keep it and have the new one.
    I’d like to start the process this summer and I’m really confused.

    Hi, I came to the UK from Spain as a EU Family member with the Nigeria passport. Few years later, I obtained my Spanish nationality and my surname was changed from my husband’s name to my maiden name. The home office has updated the information, however it been difficult updating the others since is not for marriage or divorce. The Spanish embassy said they can’t help in authorising the reason for the change. I have contacted the DVLA office regarding my drivers license and they said I should use the deed poll since my drivers licence had already been changed from Spanish to the UK licence. I don’t know how true is this information because I have called severally and I get different answers. There are loads of things I need to update including my uni details and student finance Please what should I do to get this sorted?

      To change your name with any governing body, you need a legal document. It would be best to change your name by deed pol in the UK. We hope this helps.

    My son wants to change his name as he has no contact with his father. He has a british passport but we now live in span. I have checked with deed pol and you can only change your name by deed poll if you are a resident in the Uk. any ideas of how i do this here please. many thanks

    Hello im a filipino born and acquired spanish citizen in spain i currently live in uk. My problem is the format in philippines is name maidens name and surname so when i applied citizenship tgey follow the same sequence now my maiden name became my surname how can i correct this please
