A Baja in Spain is the process by which the owner of a vehicle communicates to the Traffic Department that they are taking the vehicle off the road (temporarily or permanently). Here we tell you all you need to know about this.

You will not be able to withdraw the car from circulation or off the road, either temporary or permanently, if it has been officially immobilised with tape or blocked in the traffic department as it is necessary to cancel whatever the problem is previously. It could be to do with the Courts, or the Tax office or the vehicle is not safe. You will usually see a sign on a car saying “Precintado” in this situation, and it will record the Kms, so the Traffic Officers know if it has been moved. They sometimes immobilise the steering wheel or pedals. 

The ways to cancel a vehicle are different depending on the type of discharge from normal traffic circulation you intend to do.

Definite Withdrawl of the Car from the Road

This is notifying the DGT or Traffic Department that you are taking the vehicle off the road permanently (withdrawing it from circulation).

Definite withdrawal by transfer of the vehicle to another country

This is notifying the DGT or Traffic Department that you are removing a vehicle due to its transfer abroad, so definitely cancelling it in the Spanish Registry.

Temporary Withdrawal

This is when you advise the DGT or Traffic Department that a vehicle is temporarily withdrawn from circulation.

 The reasons for temporarily cancelling a vehicle could be:
•Personal circumstances.
•You have delivered the vehicle to be sold.
•The vehicle has been stolen

Necessary requirements

In the case of a car being taken to another country, before requesting the cancellation of the vehicle you must cancel anything recorded such as a lease agreement unless you have the express consent of the finance company to take it abroad.

If you cancel your vehicle, always remember the following:

If it is a definite withdrawal, you can only carry out the procedure in an authorised breaker´s yard and you must deliver the vehicle along with the documentation and this will give you a proof that it is taken off the road. If you entrust a third party to carry out this process on your behalf, you must ask for this proof. The receipt must clearly indicate that it is a definitive withdrawal and must include the data of both the vehicle and the breaker´s yard that has done the work.

If it is a temporary cancellation for personal reasons you must take into account that the vehicle in question must not go onto the road.

What documentation do you need?

You need to present the following documentation:
• An original application, which is provided both in the breaker´s yard or scrapyard as well as in the Traffic Department.
• Identification:-

Individuals: an official document proving your identity and address (DNI, Spanish driving license, residence card, passport plus NIE – Foreigner Identification Number).

Legal representatives: Tax identification and accreditation of the representation and identity of the signatory.

Minors or disabled people: data and signature of the father, mother or guardian, their ID and a document proving the concept.

• Logbook
• ITV document

Remember that you can authorise a representative to perform these procedures.

Vehicle Processing Request Form

In addition to the previous documentation, in the case of …

•Definite withdrawal by transfer to a country that does not belong to the European Union: A special declaration needs doing.
•Temporary withdrawal due to theft of the vehicle: generally, temporary removals are automatically reported by the Guardia Civil
at the time the Denuncia is done but if not you must report the theft to the Traffic Department,

Where to present it

• Definitive removal of the vehicle

You must deliver your vehicle to a scrapyard or breaker´s yard that displays this identification plate.
 

You cannot remove a car from the road at the Traffic Department, except for the permanent removal of vintage or historical vehicles, with special value or destined for museums. The Scrapyard issues a special certificate to prove the car has been taken off the road.

Taking a Car Off the Road to transfer the vehicle to another country and temporary loss

This can be done at any provincial Traffic Department. Spanish Solutions can assist with this. Frequent questions:-

Can I cancel a car whose owner has died?

This can only be processed when there is a probate deed which includes the car and shows the heir to the probate as the person who person makes the delivery of the vehicle to the scrapyard.

How to cancel a vehicle without papers

If the documentation has been lost or stolen, the owner must fill out an affidavit stating their data and those of the vehicle, stating the reason for not presenting the documentation.

When will I stop paying traffic tax?

A vehicle, while it is in current circulation, must pay road tax, whether the vehicle is used or not. Each tax is generated on January 1 and so to avoid a tax the next year the vehicle must be removed during that year. The owner in January always pays the road tax.

Do I have to communicate the cancellation of my vehicle to the Town Hall?

No, the Traffic Department does that.

My car was stolen, how do I cancel it?

You have to make the appropriate report to the Police or Guardia Civil and it is necessary that you advise your Traffic Department with the police report. We could assist with this. 

Can I just leave my car on my drive while I am away for six months and not tax or insure it?

No, all cars in Spain (unless you have done a baja or officially taken it off the road) must be taxed and insured.

      If you decide to scrap the car. the scrap yard will de-register the car for you but it very important that you ensure you get the confirmation that the car has been destroyed, if not you may still be liable for the road tax and any traffic fines if the car is put back on the road.

    My nephew bought a car, he did not get a bill of sale, he does not have permissio de circulation, previous owners have a baja on it. Does he have to scrap it

      Good Afternoon Alan,

      The previous owner should not have sold the car without the vehicle having the relevent documentation (ITV and permissio de circulation).

      If your nephew intends to use the car he should ask the previous owner to contact Trafico and request a duplicate permissio de circulation. Without these douments the car will never be transferred in to your nephews name and re-registered on the road, the Pólice may confiscate the car as it has been de-registered (baja).

      It would be best for your nephew to ask for his money back and return the car if the seller is not willing to request a replacement log book.

      In this case you would have to de-register the vehicle temporary (temporary baja), but as the car is in the previous owners name, they would have to do this on your behalf. Then when the car has been repaired and a buyer has been found you can do the name change and “register” the car again.       Effectively the way we see it is that your L200 is now a Spanish vehicle. (assuming you did the necessary paperwork correctly).
      therefore you will change it back to a UK vehicle in the UK.

      Where are you importing from? If UK and these are purely collector pieces for storage and not registered you could get a sworn statement before you leave UK and should not be liable for import tax.

I have no intention of bringing it back to Spain and will only use it in London for the first 2 weeks until company car is sorted. After that I intend to convert it into a dedicated track motorcycle (only used on circuit).     Hi,

    I bought a car in Extremadura and drove it to Galicia the next day. I have since found out that the ownership of the car was never transferred from the owner previous to the one I bought it from, and that the tax has not been paid for this year. The person I bought it off has been struggling to get a reply from the previous owner. I can neither pay the tax nor get the new ownership onto my name.

    What a mess. What do you suggest I do?

      The car will never be transferred into your name without the initial owners passport, NIE and signed contract of sale. We would recommend making a denuncia to the Police against the seller as they have sold the car knowing they did not have the correct documents, this will also protect you, should you be stopped by the police.

    I re registered my U.K. car in Spain which I did through a local Spanish solicitor. After signing the U.K. log book they told me that they needed it to complete the registration. I returned to the U.K. in 2018 and contacted the DVLA to re register my car in the U.K. They told me it had not been exported. It was scrapped in the U.K. at the end of 2018 on its original U.K. number plate. However I keep getting road tax bills from Spain for a car that doesn’t exist and I live in the U.K. I not sure what to do

      Firstly, we need to confirm that you are receiving the road tax bills for the same make and model of car, as the UK car which you have scrapped. If the car was not imported, you would not be receiving the road tax bills. If this is the same make and model of car, the car must have been imported, in this case the only way to stop the road tax is to de-register the car from Spain.     Hello, my car went to the scrapyard on Jan 4th this year. I just got the suma bill and it was 93 euro which is the whole year payment. Should it have been pro rata or are they correct and I am liable for the full years payment?

      If you are the owner of the vehicle in January, you would be liable for that years road tax. If you have documentation to prove the car has been detroyed/baja the SUMA office may issue you a pro rata refund, it would be best to check with them directly. We hope this helps.

    My friend left her dead husbands car,with me,to sell on as scrap.
    The paper work was not in either of our names,so it was difficult to find someone to remove it,eventually though we did,although we could not baja it,as still in her deceased husbands name.
    He took the car 2 yrz ago,and I was grateful to see the back of it.
    Now 2 years later my friend has discovered 34 fines,in her husbands name,some even on same day,…and some on continuous days.
    Obviously the car was repaired and being driven.
    One fine we discovered has the NiE of person driving,as stopped by Traffico.
    How can we solve this…she cannot pay the fines,her husband who she was divorced from,has passed.
    Can we cancel these fines from.his

      We understand your concern.

      The car should have been put into the heirs name and then destroyed, but maybe you were not aware of this.

      We would recommend making a denuncia against the scrapyard who took the car. The car should have been scrapped as per your request, instead it was put back on the road and the owners never changed.

      When you have the denuncia we would advise you to send this along with a copy of the death certificate to the DGT to try to appeal the fines. We can not confirm this will be successful, but definitely try. Usually when disputing a fine, it has to be paid and then an appeal sent to the DGT for a refund.

      The car will also continue to accrue the yearly road tax until it is deregistered (baja). We can help you with this, if needed. We will contact you to discuss this further.

      If the car has a temporary baja it can be re-registered, if the car has a definitive baja, it can not be re-registered. If the car was subject to an insurance claim, it would be best to speak with the insurer who dealt with your claim, we hope this helps.

    Goodevening Nicola, i have bought a car in Holland which came from Spain (was registered there 20 years ago, now it has baja definitivo status). Did not have any papers.
    I am trying to get it registered but the Dutch traffic office needs a declaration of no objection from the DGT, so it can be registered. A spanish friend is helping me and made a request (ticket) to the DGT to reply about this. May take some weeks to reply. Is there something we can do to speed up the reply?     Hi , a yachtie left her car with me in Mallorca about 2 years ago. It’s a 2001 Corsa right hand drive which she brought over from the UK. She asked me to scrap it. The MOT has run out as well as the insurance. It’s parked in s secluded area and not driven.
    What do I need from her to scrap it? And does she need to pay anything ?

    I am in UK on a break and my Spanish register RHD car has a defect that is too expensive to repair or drive back to Spain. I have found a breakers yard who will notify the DVLA here but how do the DGT get notified?

      If your car has been scrapped in the UK, you need to notify trafico by applying for a “baja”. This will de-register the car from Spain and stop the road tax. We can assist you with this, we will contact you directly to discuss this matter further.

    Hi, our office (Oficina Laboral de la embajada de la republica de la Filipinas – Philippine Overseas Labor Office – Embassy of the Republic of the Philippines) has an old Honda Civic with diplomatic plate that is no longer used due to non compliant emission of the engine and is just parked in one of the garages along Principe de Vergara, Madrid. We want to dispose it already as junk so we stop paying the monthly parking fee and get this property off our books. Can you give us guidance how to do this . Thanks.

    Hi there, can I bring a car with spanish registration to Ireland (seller agreed) and afterwards the seller can de-register in spain?
    As I need the log book and paperwork to be able to register the car in Ireland, can the seller de-register the car without having his log book etc?
    Could I bring the car also home to Ireland with green plates in the name of the seller as I am not a resident of spain?

      Thank you for your enquiry Maik,

      The seller can de-register the car with copies of the car documents, the original documents are not required. In regards to the Spanish green plates, these are used when the car is in the process of being imported to Spain (awaiting the ITV), the process has not been finalised as yet and would need to be done before importing the car to another country.

      You do not need to be a Spanish resident to own a car in Spain, you would need to have an NIE and a Spanish registered address. We hope this helps.

    My husband as brought a motorbike, the seller as given him sale receipts for the last two exchange sales. We don’t know when any suma tax was last paid and it isn’t ITV’d. The bike needs work done to it to get it fit for ITV. Can he work on the bike over the next few months, then when it is ready apply to register it?

      This would be something you would need to agree with the seller.

      It is extremely important that you ensure you have the following documents from the seller or the vehicle will never go in your husbands name;
      -Original signed contract of sale (signed by the registered keeper)
      -Log book and ITV (even though there is no up to date ITV)
      -Passport and NIE/TIE or DNI of the seller

      You need the confirmation that the car has been scrapped. We would recommend that you keep in contact with the scrap yard until you receive this. You will not receive this when the car is collected, maybe some time after. The scrap yard should also baja the car which will stop the road tax. We hope this helps.

    I bought a cheap box van in the UK to transport my heavy engineering tools to Spain, i started having problems with the vans engine towards the end of the journey so my original plan of driving it back to sell it cheap or scrap it were cancelled. I now have the van parked at the back of my property and i am using it as a workshop, the tax and MOT are about to run out now so can i just SORN it in the UK and continue using it only as a workshop. The van will never see the road again, its old and not worth repairing but is useful as a small workshop so could i keep it parked off the road indefinitely ?

      This is a tricky one as a vehicle should be imported to Spain if there for 6 months or more. To import the vehicle, it would need to pass an ITV test which is impossible now. It would really depend on the police, should they come to the property. We would recommend that you continue to keep the vehicle on SWORN with the DVLA. We hope this helps.

    Spanish owner came to Uk and reregistered in Uk and kept it there for 10 years
    She sold it to me
    I would like to take it back to spain is it possible to just get the original licence plate made up and notify or do I literally would mean reimporting paying 31% etc etc

      If the vehicle is on UK plates, or different plates other than Spanish, the car needs to be imported to Spain again regardless if the cars origin was Spain.     I am one of 5 beneficiaries of my uncles will. He died in Spain last year and we have just recently completed the inheritance process and sold the house. There is still a Car and motor scooter to be sold but we are having problems transferring the vehicles into one or all of the heirs names as none of us is a Spanish resident. We have agreed a sale but can go no further. Can this situation be resolved?

    Hi there

    I have recently been given an infraction on my UK registered car in Spain by customs. Basically, I gave the car to someone who was going to purchase it when I had sent the log book to them from the UK (did not take it with me at the time). In the mean time they got inspected by customs who found this and said that the car has to leave the country within 6 weeks. I want to scrap it (legally) instead of taking it back to the UK. Is this possible without paying all sorts of IVA, fees and import taxes please?

    Hi there,
    I visited Calpe in Spain for 3 months from the UK taking my car with me. I then sold my car to a car dealer in Spain and sent them the log book in the post however, this was lost by the post office. Now, it seems the only solution is to scrap the car and I’ve found a local company who will do this however, the original car dealer has told me that the local ‘fiscal and boarder patrol’ will charge me lots of different fees if I get this scraped . Is this correct?

      If the car is being scrapped and not put back on the road we would not think there would be any taxes as the car would not be leaving Spain. However, we are not a scrap yard or border/tax control. We would advise contacting an independant scrap yard for their advice. We hope this helps.

Also if the owner cannot attend the Office to confirm that the car has been scrapped, is this something that you can do on their behalf? Also what if you no longer have the registration document?

      If the car is scrapped in the UK, you will need confirmation of this. The car would then need to have a definitive baja carried out to advise trafico and stop the road tax. This can be done from the UK.

      We can help you with this once the car has been scrapped. We would need copies of the following;
      -Confirmation the vehicle was scrapped
      -Vehicle owners passport and NIE certificate
      -Copies of the car documents (ITV & log book)
