If you have decided to return permanently in the UK having been a Resident, then there are certain things that you need to be aware of, and to do.  We can also assist with returning to other countries to live. Please talk to us about your individual circumstances.

Firstly, of course, we can help with you with the legal work associated with selling a property and assist in finding a respected property agent to deal with the sale.

We can also assist with the paperwork for a change of ownership if you are selling your Spanish car.

If you are returning to live in the UK permanently, it is important you tell both the UK and Spanish authorities.

Paperwork

You should deregister with:

a) the local town hall if you were registered there (if you have been on the padrón)
b) the Spanish National Police (cancelling your Residencia)
c) your local health centre so that your SIP card is cancelled.
d) tax office – cancelling fiscal residency

We can assist with all of this and it is important as when you return having done this will help prove you are living in the UK.

In addition, of course, if you receive UK State Pension or benefits payments, you must tell the International Pension Centre that you are returning to the UK.

Healthcare

If you receive healthcare in Spain through the S1 form rather than working, so as a pensioner, then contact the Overseas Healthcare Team on +44 191 218 1999 to advisw that you are going back as the S1 needs ot be cancelled which covers your healthcare in Spain, otherwise the UK continues to pay for you.

Tax

With regards to tax, then when you move back you will be a UK resident again and although we do not advise on UK tax, you will pay UK tax on your UK income and any foreign income and gains, although you may not have to if your permanent home (‘domicile’) remains outside the UK.  You will need to contact a UK tax adviser for advice. We can assist with cancelling your Spanish tax residency.

When you are back you need to call the HMRC and ask about registering for self assessment, but you do not need to if you are employed and don’t have other income. Telephone: 0300 200 3300 Outside UK:00 44 135 535 9022 You need your National Insurance number to hand.

National Insurance

If you are not a pensioner then you usually start paying National Insurance again if you work in the UK. If you didn’t pay it while you were abroad, you can check your National Insurance record to see how your State Pension might be affected and ask if you can make extra payments so you can catch up having the right amount for your future pension.     Would you be able to help if I was thinking to go back to Spain after living in England for 14 years please? What would I have to do with my pension papers and if I have to notify someone about this before leaving the UK?

      If you intend to move back to Spain, it would be best to speak to a Fiscal Advisor or your Pension Providers, to explain your situation, they will then be able to confirm what would happen in your situation. We hope this helps.

      Thank you for your enquiry.

      From experience the hospital will provide images on a disc and the factual medical notes in a form. It would be best to check with the hospital directly as all hospitals may be different.

    We had to leave Spain quickly, returning to UK after selling our house and was told by a Gestoria that we could renounce our Spanish residencia’s at the Spanish embassy in UK. Is this true as I cannot find any information about this issue? Your comments would be welcome.

      Dear Maureen, I am not sure, but if you find when you ask at the Spanish Embassy that you cannot do this, then I think we may be able to help de-register you with the Police with a power of attorney. This is something very rare that we get asked about, but we believe they were doing this prior to the new TIE system. Everything is a bit up in the air at the moment, as we do not seem to be able to get appointments, but if you email enquiries@spanishsolutions.net in a few weeks and ask if we can do this with a power of attorney, we can find out. We would also try to obtain a certificate of non-residency for you to show this. With kind regards.

    Hi, I am selling my Spanish property after being a resident here for 5 years. I am returning to the UK. My question is if i sell my property in Spain in November 2020 and purchase my main residence in the UK after December 31st will I then have to pay capital gains tax to Spain?

      Without having full details of the figures of your profit etc I cannot answer fully. At present if you are selling your main residence in EU there are CGT allowances but we do not know what these will be after Dec 31st at the current time.     I moved back to the UK due to covid in June 2020 with the hope to return in Feb 2021. I did not de-register as I want to return, do you know how long I will be in the UK until I loose my residencia? I am working in the UK, do you know if this automatically de-registers me as I am earning here? Thank you for any advice.

      You would have been due to pay tax whether resident or not. You should contact a fiscal gestor, or your previous employers accountant about any refund you are due.

    Hi. I’m moving back to UK due to covid, I haven’t had time to register as a resident in Spain and I earn less than €22,000, so I’ve been informed that I don’t need to do a tax form in general, so Can I just leave Spain without any forms when I quit my job? I’ve been at my job for only 5 months, do I need to inform the tax people or is it fine considering I pay my tax monthly and am not required to fill in the form due to being under the threshold?     Having lived in Spain for 15 years, worked, paid taxes and NI payments I am now retired and in receipt of a small spanish pension and a Spanish widows pension. If I move permantly back to the uk will I still receive the two Spanish pensions and where do I pay the tax to?

      If you are going back to live in the UK, the Spanish pension can be transferred to the UK when drawing down any UK pension you may have. The other option is to contact the Social Security, in Spain, to confirm if you would be entitled to a Spanish pension and also the amount.     I am returning to the UK after living in Spain for five year and making the necessary appointments but which appointment do I need to book with the police to do the baja? there is no option so i’m not sure whether to just book any and then turn up with the EX18 and say i’m leaving.

      Thank you for your enquiry.

      To revoke your residencia, you dont need an appointment. You need to visit your local Foreign Office with a letter, in Spanish, confirming you no longer wish to be resident in Spain ect and your original residencia. The office in which you attend may differ region to region, best to check directly with the Foreign Office. We hope this helps.

    We are age 72 and 65, and have “residentia”, and have lived in Spain for 4 years …. We have just sold our house at a profit and planning to move back to the UK …. We understand there will be no CGT, but may be some land value tax, but someone said they may charge a 3% holding tax, or is this but just for “non-residents” selling a house? (We plan to buy a house in the UK) ….

      If you are residents in Spain, you do not have to pay the 3% tax when selling the property. The land value tax you mention is the Plusvalia, so yes, you would have to pay this. In regards to the CGT if you are over 65 years old you may be exempt, but only if you have been registered on the Padron for the past 4/5 years. You would also need a Fiscal Residency certificate from the Tax office.

    We are returning to the UK soon. Is it possible to submit our 2021 tax return now and make any payment due before we leave, I know payments are usually taken around June but we will be closing our Spanish account. If this isn’t possible can we pay it from our UK bank account.

      Unfortunately, you can not pay the tax return early or pay from the UK bank. If possible it would be best to leave your Spanish bank open until the payment has been taken. We hope this helps.

    Hello. I’m thinking of moving back to Uk. I understand I have to deregister with the police inform the town hall and tax office social security. As a payer of self employment for 6 years what happens to all the money I’ve paid. I’m 50 so now where near pension age. On my arrival to uk what do I do about my spanish driving license?. Do I inform dvla, and they will help?. Also I have a spanish registration camper. Can I move what little belongings I will have along with my pet dog in this back to Uk and then re register the vehicle to Uk. If so what would need to be done custom wise. I would be moving back to my fathers house so it would only be some personal effects and clothes. So much to think about and a stressful time right now. Thankyou for any help.

      Afternoon Lisa,

      You would need to de-register from the padron and also revoke your residencia. When you revoke your residencia, the tax office will be notified. You will also need to cancel you autonomo.

      When you become pensionable age, the HMRC would look to Spain to recover any pensions available to you.

      In regards to importing your camper van and changing your driving licence to the UK, you would need to speak with the DVLA.

    I am looking to go back to the UK having worked 13 years in Spain. I understand I can pay additional 2 years NI to Spanish with prior agreement to get minimum 15 years and hence the Spanish pension even if I’m not in the country? My other question is if I work remotely from the UK and get paid by Spanish company what would be the tax implications be.I read about expact from Spain being taxed at 24 flat rate and some double taxation agreement.

    I applied and received a TIE in November 2020 but didn’t actually take up residency. I’m still U.K. tax resident and pay non resident tax and private health insurance. I’ve spent 5 months per calendar year in Spain and have continued to travel within the 90/90 day category. What is the procedure for de-registering and will it affect me continuing to visit Spain

      To cancel the TIE card, you must de-register from the padron, in person and then revoke your TIE card at the Foreign Office. We can help you with the later part if needed.

      If you have Spanish residencia/TIE card this means that you are a Spanish resident. In this case you should not be paying non residents tax. This is for non residents, people who do not have their residencia or TIE.

    I have been a permanent resident in Spain since 1993. I am retired and receive a Spanish state pension and a British state pension.
    I wish to return to the UK to look after my elderly mother. So this will not be a permanent move but is likely to be a fairly long time. I don’t wish to give up my Spanish residency as I wish to return.
    What steps do I have to take to do this?

    Hi,

    My wife and I have been living with family in Spain since September 2021. We are now planning to return to the UK permanently. My wife and I both have residency (I have a Spanish passport and she has an EU family card). We are both registered on the padron at the town hall in Barcelona and also each have cards with access to full Spanish healthcare.

    My question is, we want to deregister soon from the padron so we aren’t considered tax residents for the next tax year here. If we deregister from the padron a couple of weeks before we actuality leave, would we still be able to access healthcare if necessary? It’s unclear if upon deregistering, whether the town hall informs the local CAP of the change and therefore our access to healthcare is revoked, or is this something we need to inform the CAP of ourselves and therefore our access would remain available until then?

    Hopefully this makes sense.

      As far as we are aware the padron is not linked to the health cover. It would also depend on the way you obtain your health cover, if you pay Convenio especial or work in Spain. We will contact you directly to discuss this matter further.

    Hi, we are UK citizens resident (and tax resident) in Spain for nearly 4 years. If we were to leave Spain permanently in, say, April 2023, my understanding is that we would not be taxable in Spain for the whole year as less than 183 days in Spain in 2023.
    However, if we arrived permanently in the UK on say 20th April, what is our tax situation from 1st Jan to 20th April? If not taxed in Spain, would we be subject to UK taxation from 1st January even though only arriving in April? Many thanks in advance.

      For the year 2023, from January to April, you will be subject to UK taxation even though you are arriving in the UK in April.

      If you spend less than six month in Spain during the fiscal year (1st January to 31st December) you would not have to pay any tax in Spain for that year. We hope this helps.

      If you have the green residencia, we can help you to revoke the residencia without you being in Spain. If you have the TIE card, this would need to be revoked by you, in person at the local National Police. We hope this helps.

    Hi. I am moving back to UK next week. I have not registered at the padron for over a year so do I still have to deregister? I thought it expired after 3 months. I have TIE. Can I pay a company to cancel this on my behalf? I have been told with ref to Hacienda, I have been told I have to apply for a certificate of fiscal residence from the Uk and attach a council tax bill to attach to Modelo 030 once I have this. Is this all correct?

      When leaving Spain, you need to de-register from the padron, in person. Sometimes, the padron certificate can not be used for proof of the address after 3 months. This would depend on the governing body requesting it. You would also need to revoke the TIE card before leaving Spain. Again this would need to be done by you, in person. A third party can not revoke the TIE for you, unfortunately.

    I need assistance with paperwork to leave Spain. I believe I must go to the local Ayuntamiento, then the police located in Badajoz or Zafra? My husband died a couple of years ago, and he was the driver, and whilst I have Spanish friends that could drive me I really need help with the language, I think its important to know what is being said to me.

    I have an NIE number not Residencia. My husband spent most of his time in hospital and we/I never got around to the legal side of things. I’m going around in circles and finding the whole thing overwhelming. I don’t want to get into trouble with the police. I don’t know what documents I need, I keep looking at Google and get all sorts of information which says different things. I hope you can help.

    I have a permanent Spanish TIE card and am a British passport holder with a Spanish Driving licence. I am 59 years old.
    I am thinking about relocating back to the Uk. I am unsure at this stage wether I will return to Spain.

      Morning Karen,

      If you decide to leave Spain, you would need to de-register at the padron office and also revoke the TIE at the foreign office. Please note, that these both must be done in person. If you are located in the Alicante or Murcia region we can help you with the revoking of the TIE card.

      If you are tax resident in Spain (pay RENTA each year), you also need to de-register with the tax office. We can help you with this regardless of where you are in Spain.
