We recently received this question:

“I am a non-resident, and myself and my husband own a property here on the Orihuela Costa. We have a Spanish Will. Am I right to assume that if I was to die my husband would have a Tax Allowance of €100,000 against the inheritance of my 50% of the property?”

Our reply:-

Thank you for your enquiry. If the property is in the Valencian Community (and Orihuela Costa is), then the tax-free allowance currently for a wife or husband receiving an inheritance from their spouse is 100,000€. We can advise you further on inheritance tax if you have any further queries.
