Fortuna Golf – Claiming back a Lost Off-Plan Deposit

We have a number of cases whereby our clients bought off-plan properties in Fortuna in the region of Murcia many years ago, and the properties were never finished and like many other developments like this in those years, the clients lost their deposits.

Fortunately, now many years later, justice is being done and an Alicante Court condemned Banco Popular a while back to repay back the funds that were paid into that Bank for the promoter´s account to people who had invested in the properties in Fortuna and lost their money.

In fact, this situation also applies to other promoters and building companies whereby funds were paid into the Bank of the promoter, as the bank should have segregated funds on to a separate account, as per law 57/1968 on advance payments on home sales, which was to protect amounts paid by consumers.
