 Traffic Fines In Spain – The number of traffic fines in Spain has risen over the last few years, leading to many people claiming that it is simply a way to increase income for regional Spanish Governments. We’ve taken a look at how to know if you’ve been fined and what your options are.

The majority of fines are for parking in a prohibited area, particularly in the same town where the driver resides; the second reason is speeding offences. When you receive a fine this will detail the reason, location, date and time along with sanction and, if applicable, the loss of points on the licence.

How Are Traffic Fines Notified?

There are four ways that you can be informed about a fine, or find out if you have outstanding fines:

1. You are stopped whilst driving (by the Guardia Civil or by another traffic agent). In this case, you will be given a written notification of the traffic violation there and then and will be asked to sign it. If you sign this doesn’t mean you can’t later make a claim against the decision. And if you don’t sign it doesn’t mean you’ll have longer to pay. You’ll be given the option to pay on the spot, with a 50% discount. If you don’t pay you can still take advantage of the 50% discount in the following 20 days.

2. By registered post to your address. If you were not the driver named, you have 20 days to notify the full details of the person who was driving at the time (name, address and identity document if known). It’s not a good idea to try to get out of this by saying that you didn’t know who was driving, in these cases the original fine will be either doubled or tripled.

3. By email. You can only get this if you have registered online and given your email address for notifications. You’ll need a digital certificate to access this service and have 10 days to read notifications. We don’t suggest using this service as if you’re on holiday and don’t have access to your digital certificate then you won’t be able to see the notifications.

4. Also in the Official Traffic Website. This website is a “notice board” for all notifications that haven’t reached their destination, for example, due to a change of address. On this website you don’t need a digital certificate, just put in your NIE or the number plate of your vehicle to see if there are current or non-current notifications.

Only you can decide whether to pay upon receipt of a fine or not but take into account that the reduction for prompt payment is 50% of the fine, so if you are going to pay anyway it makes sense to pay sooner rather than later.

Payment can be made either:
• Online (need digital certificate)
• By calling 060
• At any Post Office
• At any branch of Banco Santander

If you think you shouldn’t have been fined then you can opt to:

1. Explain your reasons, in writing, as to why you think you shouldn’t have been fined. You have 20 days to do this and by doing so you lose the chance to take advantage of the 50% reduction. If you receive a reply that your explanations have not been accepted, you’ll have 15 days to pay the full fine. However, you also have a new 30-day period to make another claim against the decision. After this, your only option is via court.

2. Claim via your insurance company (some offer this service along with your car insurance policy) or a specialist company. The average time taken is around three to four months and around 30% of people win their claim. Of course, a specialist company’s fee may exceed the amount of the fine!

3. Go to court. You must use a lawyer (mandatory in these cases) and pay the corresponding court fees (these fees cannot be more than 50% of the fine). If the fine includes loss of points, you may feel that it’s necessary to contest it in court. Remember you’ll only get all your money back if you win and the sentence says that the Administration has to pay your costs.

Tips
1. Regarding traffic fines, all the time periods mentioned in any official notifications include the seven days of the week (in other words Saturdays, Sundays and any local or national holiday too). If you decide to pay, make sure you’re not caught out by waiting for the last day.

2. It’s not a good idea just to ignore the fine as your bank account could be embargoed.

3. Don’t think that just because you don’t have a Spanish driving licence or Spanish plates on your car that you can’t be fined. National and local level initiatives have been implemented to ensure that tourists or residents no longer get away with not paying traffic fines.

    I have received a parking fine from 4 years ago!! Is this legal? Is there no time limit? I am not disputing the fine, only the amount of time that has lapsed since the occurrence. If I pay immediately, do I only pay half?

      Having checked this morning, there is no time limit on a traffic fine we are afraid, the paperwork you have should confirm if you can pay half the fine before a certain date. We will not be able to confirm if half can be paid without seeing the fine, we are sorry.

    Hi there, I have a parking ticket in Cadiz which my rental car company forwarded to me. It doesn’t specify how I can pay for this, there doesn’t seem to be an option to pay online. How do i pay for this while I am abroad? Thanks

      Hi Rob, How annoying. That is a very long way from us I am afraid and we do not know the rules for that region. I suggest you contact the rental car company and ask them to let you know, as I am sure they will be aware. Or alternatively a lawyer in Cadiz.

    “Error, the field Date of Notification is not correct.” I’ve done it all different way and on different browsers but no luck. Have tried ringing but no one answers there phones. Any further suggestions.

    We got a parking fine on Sunday 1st Sept
    In Alcudia on the island of Mallorca. We did not know that we had to pay it specifically at the police station in Alcudia. We tried to pay it before we left but people told us we only had to pay it in Alcudia. They also said we can pay it on the website but We are unable to find an english site or proper assistance. The ticket is also in Catalan. How can we pay this online without having any future repercussions? Also the rental car company was not helpful they told us to just take the flight home and we should pay online But this is proving very difficult. Please help us.

      We understand your frustration.

      Usually the parking fine is sent to the registered keeper of the car after the incident, these can take some time to be issued, the initial slip is only a notification and can not be paid using this.

      If you were driving a hire car, the hire car will receive the fine as they are the registered keeper. When received they will possibly deduct the costs from your card details, which they have registered or they may forward you the fine to pay online.

    Hi, I parked in what I thought was parking (as other cars were there too), no signs to say no parking, i.e. yellow lines etc or anything to say we weren’t allowed. Turns out it was a bicycle lane (no sign or markings though to suggest that either) should I appeal – my lawyer says this happens all the time and even if I do appeal they won’t get back to me before the 50% reduced fee option is payable, and the police will find any excuse for me to have to pay it.

      Your Solictor is correct, to appeal would be a lengthy process.

      It may be best to pay the fine before the 50% reduction period ends and then to submit an appeal.

      To appeal you would need copies of the fine, proof of payment and pictures as evidence.

    Hello, I have just received a letter from Trafico telling me that I now owe 900 Euro’s for an offence that was committed back on the 23rd March (probably a speeding ticket) but I never received anything in the post from trafico . I am registered as living in Spain with Spanish plates. I have written to the trafico main office in Leon, and ask for proof of the original offence. Can you tell me is there a limit in time before they will impound my car ?.

      We are unsure how long it will take for the Pólice to impound your car, this usually happens if the fine is not paid and the interest acrues and then becomes an embargo.

      900€ is very high for a speeding fine which happened this year, we feel it could be for a fine from many years ago which has not been paid. Please feel free to email us a copy of the fine and we can check to see what this is for. We hope this helps.

    Hi,
    I live in the US and received a speeding camera ticket from Spain (Madrid or Seville). I keep getting “error in the date of notification” when trying to pay online even though i have tried every date possible since the date of the violation. I also tried calling the number and was getting automated messages. I do not speak Spanish. How do you suggest i go about paying this fine ? I want to avail of the 50% reduction which should still be within that timeline. Thank you !

    Hello, I live in Spain in Cadiz. I hired a car and parked on yellow lines where the car was towed to the Policia Local. The ticket was left on the bonnet and faded in the sun. I got a replacement but the seven days were up. I now cannot pay at Caixa Bank Because the date has expired or online. What happens next, I just want to pay it.

    Hi….i received a letter saying i did not stop at a stop sign and jad to pay 600euros at our post office back in Jan, we now have received another letter with the same amount however because it is in spanish we are not sure why or do we have to answer the letter as we had to sign for it…very confusing as i already paid for this in Jan….please can you help…..kind regards Garry

    After bank account gets embargoed and you choose not to pay. What will happen next? What if you choose to NEVER pay the fine? They said I had international car insurance and was not sufficient in Spain so they gave me a 750 euro fine

      Dear Don, If your bank account is embargoed, there was probably a Court process? They will keep trying to take funds whenever money goes in. Even opening another bank account in Spain, they will be able to see that and also claim on it until the debt is satisfied. There is not really an easy solution I am sorry. Kind regards

    Hi, my wife recently sold our car as we relocated back to the UK. We have a compraventa with the buyer stating the time and date of sale and the buyer had sent through a Justificante Profesional Del Vehiculo from a Gestoria. Anyway, 2 days after the sale, the buyer had been caught speeding by a radar going over 120 km/h in a 60 km/h zone.

    DGT has now sent through a letter to my wife saying she needs to pay the fine and take 6 points on her licence.

    She did not realise she needed to pay 8.50 EUR to DGT and notify them of the sale at the time.

    How does she contest this fine as she was not the legal owner of the vehicle any longer and how likely is the DGT to listen?

      Your wife will require to contact Traffico with evidence that she had sold the car. It may be worth also considering a Denuncia against new owner if they are not willing to confirm the fine is theirs.

    This is mentioned on DGT Website:

    “Si pagas la multa en periodo voluntario y te beneficias del 50% de reducción, se entiende que renuncias a presentar alegaciones. Por lo tanto, cualquier recurso o alegación que presentes tras haber pagado la multa en período voluntario, no tendría efecto. Del mismo modo, al interponer una alegación, pierdes el derecho al descuento del 50%, por lo que si tu alegación es desestimada, deberás pagar el 100% de la sanción. ”

    Does it mean that if I want o use 50% reduction, I will loose my chance to contest the fine?

    Hi,

    A Spanish friend recently received a fine of €300 for speeding with 123 where the limit was 90. She said that she didn’t drive and that it must be my fine. So she sent documents to DGT to identify me as the offender. I really don’t remember that I drove on this street on the mentioned day. What are my options if I receive the fine in France? Is there any chance in saying that I can’t remember the incident on this street and in this car from somebody else at all and asking for further evidence that I was the driver? Afaik, nothing can be taken as evidence that I was the driver (if I was. I really don’t know). But can this create problems for my friend who told DGT it was me?

      Dear Michael, Oh dear. Well DGT will want someone to pay and if she has said it is you then they may accept it is your fine and send you the invoice to pay. We would advise you not to ignore anything, all you can do is try to make an appointment and discuss it if you think it was not you. But do not ignore it as the fine will only increase and it will be against you from what you have said. I think they might accept one denial of responsibility, but two. But I would wait to hear for now. With kind regards.

    I got a parking ticket in 2015 in Mallorca. The official notice was sent to my home in Canada but I simply ignored it. If I return to Spain, could I have a problem in the airport ? Thanks for your help.

      We are unsure if Trafico would disregard the fine, or whether they would add interest and it would turn into an embargo like it would do if you stay in Spain.

    On Jan 9th 2021 I had an accident with no witnesses & no-one else involved, I am not a fast driver being 76.I took a R.H. curve at about 35 Km /hr.& unknown to me there was a patch of ice in the shade of olive trees, I skidded, not much but my car finished 90 % in a shallow baranca.Neither my lady friend nor myself were injured. There were no witneses, but a few minutes later a couple of drivers stopped & helped, calling my Ins Co grua & the local& Guardia traffico.Officers said it wasn’t my fault.Later on it was all cleaned up & my car brought to my local garage( uneconomical to repair ) .On Mon 15 Feb I got in the post a trafico fine of 200€ (discount info as normal )n& paid the 100€ plus a fee of about 7€ at a nearby town post office.Now I think this is injust & can’t understand the Guardias apparent contradiction.Advisors like yourselves say “pay up & shut up ” or things will only get worse.Surely something should be done about this cruel action.

    I got a speeding fine in July 2020, before the car was officially in my name, but was in procession at the time (Due to COVID). The previous owner requested I pay the 300 euros for the fine to him, which I did. Then I was sent a letter saying to identify the driver as me, which I thought was a receipt for the fine. So did nothing, and consequently received a 900 euro fine. I organised with my insurance company to challenge this, which was successful, and the original 300 euro fine was put into my name, which I then paid. For the last 4 months I have been asking the original owner to pay back the 300 euros I paid him to first pay the fine. At first he said he was contacting dgt, and they were not responding to him, and now he completely ignores me, and refused to send me the invoice for the fine he says he originally paid. Is there anything I can do to get the money back that I paid to him for the original fine?

      Dear Mike, It really is terrible when people are dishonest, we are so sorry to hear this. Unfortunately there is not much you can do, a legal letter would not be worth it as they could easily ignore it and it is throwing good money after bad, and taking him to Court would cost more than the fine. The only thing I can suggest is to keep requesting it, so maybe he pays you to stop you pestering him. I am sorry. Kind regards

    Hello, we received a parking ticket in Sevilla. The notification said it apparently was a spot with a time limit and we did not have a ticket in the window. However, there was no signs of this at the parking spot. The car was rented so I assume we have to wait for the ticket to be sent to the car rental, but can we issue an appeal already just with the notification left on the car? How do we issue an appeal? Very thankful for any help.

      The fine will go directly to the hire company, as they are the registered keeper of the car. We assume the hire company will deduct the fine from any cards details which were taken at the time of the hire.

      To make an appeal, you will need a copy of the traffic fine as you will need the reference number on the fine, there will also be an address detailed to where you can send the appeal. We hope this helps.

    My husband’s car was taken by a grua to the pound because the insurance had run out, Police gave him 2 tickets, 1,500€ and 200€ both can be halved if paid in a few days. The problem is we can not afford to pay this and get the car back, it’s not even worth that amount. We accept it will be disposed of/crushed but how can we get our belongings out of the car first.
    What will happen because we can’t pay ?

      It is extremely important that you discuss the fines with the DGT, and the situation with car speak to the Police. The car may not be destroyed straight away and will incur charges for each day it remains in storage. The costs will escalate if not addressed. We hope this helps.

    Hello. We rented a terrible camper from Indie Campers 1st November. We returned it the following day as it was not fit for purpose.
    They then gave us an ‘upgraded van’ it wasn’t.
    We did not sign for the new van so I think they have gifted us this van. If we have not signed and get tickets who is liable. They have done this to so many people and ruined so many holidays. Just trying to figure out the legalities. Thanks for any advice. Kirsty

      It would be best to go back to the rental company and discuss this situation. The rental company will receive the notifications for the fine as they are the registered keeper of the vehicle.     I recently received a fine from San isidrio town hall (alicante) for breaking a red light and not respecting another driver stopped at the lights, there is a date of the said offence but no time Or picture or any other proof of this, the offence was in July it’s now December but the fine is stated as “grave” So still in there time limit for the fine but is this offence realy “grave” And can they just issue a fine with no proof??
    I don’t believe it was me Or my car

      With most driving fines, a picture of the car would be supplied. The picture would be taken from the traffic camera that was in the area at the time. The registration number would also be stated with the make and model of the car. We would recommend contacting the town hall/department that issued the fine to discuss this matter further and ask for the evidence if you have not already received this.

    Hi. I received a Fine for a Limited Traffic Area in Mallorca.
    I went there in July/2021 and received the fine only now ( January 2022).
    Is there anyway for me to appeal for this fine?
    My driving licence is from UK, what happens if I don’t pay this fine?
    It has been a long time since I went there and I’m not dure if i passed in this avenue that I was fined for, I also can’t remember if there was any sign for this limited traffic area. It’s hard for me to pay something I’m not sure I have done wrong.

      If you have any disputes or wish to appeal the fine, you need to write to trafico, the address will be on the letter. We are unsure if the points on the licence can be transferred to a UK licence, this is best checked with the DVLA.

      We can confirm the Spanish and UK authorities do communicate when it comes to traffic matters and would not recommend ignoring the fine as it will continue to add interest until paid. We hope this helps.

    Hi, Hoping you can help. We recently received a parking fine for parking our van in a free car park in Estartit which turns out had a height restriction (which our vehicle exceeded). The fine is for a whopping 100 euros. Is that correct? WE can’t help thinking that we have been targeted because of our GB badge. Are there any guidelines to fines by Spanish traffic wardens/police? And is there any way of appealing our ticket/fine? Many thanks for your help.

      100€ is correct for a parking fine. If you feel you have grounds to appeal, you can contact the governing body who issued the fine. The address should be on the fine itself. If you pay the fine within a certain date you should be offered a 50% discount. We hope this helps.

    Hi,
    Whilst self isolating with Covid 19, unknown to me a Correos slip was left in my remote mail box. As soon as I was well enough I attended my local La Nucia Correos with said slip to find that it was for collection of a letter from Trafico, but as the date for its collection had passed the letter had now been returned to Trafico. I suspect waiting for a second delivery would not be wise, any suggestions?

    Hi, I see on my insurance company that a fibe gS been registered to me from March last year by Barcalona. However I have never driven to Barcelona or been there as a visitor. No evidence is attached to the notification. I have not received anything by email and my registered details are all correct.

      Fines wont be notified to you via your insurance company, the fine would be sent to you via the post unless you have chosen another method of delivery (email ect). If you have a digital signature, you can access the DGT website to confirm if you have any pending fines and their details. We hope this helps.

    Hi, I received a speeding fine in Dec 2022 and I now have received another fine for 300 EUR related to the original fine. When I received the fine in Dec, I paid it immediately and the car is registered in my name. The fine I received today is because I did not declare myself as the driver when I paid the fine in December – I genuinely didn’t realise I had to make this declaration. I just paid the fine ASAP.
    In your opinion, is there any point in trying to contest the new fine? or should I just go ahead and get it over and done with and pay it? I assume I still need to declare myself somehow as the driver otherwise I will probably end up with another fine in a few months!

    Hello,

    I have received a parking fine from Spain, I was on holiday there at the end of June, the parking fine date of infringement states 25th May, I was not in the country then. My passport number is incorrect, and the photo of the car they have provided is not the car I hired. It is a different colour and reg and it not anything I have even driven.
    How should I move forward with this. It looks like they have the wrong person surely!?

    Hello I was involved in a very nasty accident . I pulled out at a junction to a main road having obviously checked there was nothing coming . My 2 passengers who are also drivers looked automatically and agree the road was clear. The next minute there was a horn blaring and this car crashed straight into my side if the car rolling me over at least 4 times . We are very lucky to have escaped serious injury. Unfortunately I was trapped inside the car for quite a while and the remaining tine was taken up with police taking details of ny driving licence, TIE , breathalyser test (I never drink when driving) and arranging with my insurance to get my car picked up by the grúa. The other vehicle were Spanish and obviously gave the police their version of events which state that I did not stop at the junction with a stop sign . This is a blatant lie but unfortunately there were no independent witnesses. I had already asked my insurance company if they can dispute this as Friné evidence it should be obvious the other vehicle was considerably breaking the speed limit but they seem to think such an occurrence quite common
    Today I have collected a registered letter dated 21st December but not attempted to be delivered until 2nd January and it is a fine for not stopping of 200€ (I have a few days to pay and reduce it to 100) but the worst is 4 points on my licence. I would like to
    appeal aa I’ve had an unblemished record for 11 years apart from a fine some years ago for not noticing despite looking a one way street sign
    From what I’ve read I’ll lose the reduced payment option if I don’t pay in the next few days so I’m
    wondering how successful an appeal might be. I certainly don’t have the funds to go down expensive legal channels

      To dispute the fine, you would need to contact the department who issued the fine (details will be on the letter) and provide evidence to why you are disputing the fine. However, the normal process in Spain is to pay the fine and then dispute it. This will stop the fine increasing due to non payment as interest will be added until paid.

    We followed incorrect advise from a hotel receptionist who said that parking in a blue bay at weekends was free in Benidorm, our hire car was towed. We went to the compound and paid both the towing fee and parking ticket and was told that was all we needed to pay.
    Following this the hire car company sent another parking fine and a $50 euro admin fee.
    As this had already been paid we have been in correspondence with Sumo Geston Tributaria to provide evidence that is has been paid. They have confirmed that we were given 2 parking tickets by different wardens, one at 10:49 and another at 11:03. They have advise we need to contest it by sending a written letter.
    We live in England so there will be delays in them receiving letter with the exact same evidence they have already had. We feel like we are being sent around in circles with delay tactics and in the meantime the fine will double and the hire car company will probably charge more fees.
    Are they advising of the correct process despite already having all of the evidence that they have made a mistake? Is there anyway we can be escalate this to be resolved?

      Morning Corrine,

      The usual process in Spain, when disputing a fine, is to pay the fine and then submit a letter with evidence for consideration/appeal. In this case, you would need to send the letter to address on the fine and include the fines, proof of payment and evidence you have to help your appeal. We would recommend that the letter is sent recorded delivery and signed for. There is now way to escalate the problem we are sorry. Please note, if the fines are not paid on time, they will accrue interest until paid. We hope this helps.
